Penalty For Sodomy In Ottoman Law

Abstract
Islam forbids all kinds of extramarital sexual intercourse except for those based on legitimate marriage – including sodomy –, considers such illegitimate acts as sinful, and imposes deterrent penalties. Sodomy was also regarded as an offense in Ottoman law, which prescribed and administered tazir punishment for such offenses in accordance with the views of Abu Hanifa.
Özet
İslâm, sahih nikahla meşru cinsel ilişki dışındaki her türlü cinsel ilişkiyi –livata dahil- yasaklamış, bu fiilleri suç saymış ve caydırıcı cezalar öngörmüştür. Osmanlı hukukunda da livata suç sayılmış, bu suça Ebu Hanife’nin görüşüne uygun tazir cezaları önerilmiş ve uygulanmıştır.
