Obligation of Employment of Private Security Officer Who Bears Requirements in the Private Security Contract and Qualifications of the Private Security Officer in This Regards

Abstract
Private security contracts are two or multilateral legal transactions that both par-ties are under obligation. While the primary obligation of the private security company arising from the contract is to provide security by the terms of the cont-ract, the obligation of the other party of the contract is payment of wages. The employment contract is a general legal transaction between the private security company and the private security officer. The private security company usually fulfills its obligation which stems from the contract through private security offi-cers. In this sense, it is the private security company that will employ the private security officer and fulfills the execution under the terms of the contract. The be-havior and style of the private security officers to be assigned in a public institu-tion and a shopping or entertainment center should be different. Being a private security officer is bound to very strict conditions in our country. Many of these conditions are health conditions, but there are many legal requirements too. In this sense, private security officers may lose these conditions which were intro-duced during the employment period. In our study, it is tried to explain the pos-sible legal consequences of such a situation and the conditions that are required to be a private security officer
Özet
Özel güvenlik sözleşmeleri her iki tarafa borç yükleyen iki veya çok taraflı hukuki işlem niteliğindedir. Özel güvenlik şirketinin sözleşmeden kaynaklanan aslî borcu güvenliği sözleşme şartları doğrultusunda sağlamak iken sözleşmenin diğer tarafının borcu ücret ödemeye ilişkindir. Özel güvenlik şirketi ile özel güvenlik görevlisi arasındaki hukuki işlemin niteliği ise genellikle iş sözleşmesidir. Özel güvenlik şirketi sözleşmeden kaynaklanan borcunu genellikle özel güvenlik görevlileri vasıtasıyla ifa eder. Bu anlamda özel güvenlik görevlisini istihdam edecek olan da, sözleşme şartları çerçevesinde edimin ifasını sağlayacak olan da özel güvenlik şirketidir. Bir kamu kurumu ile bir alışveriş ya da eğlence merkezinde görevlendirilecek özel güvenlik görevlilerinin davranış ve üsluplarının farklı olmasının gerekliliği açıktır. Özel güvenlik görevlisi olmak ülkemizde çok sıkı şartlara bağlanmıştır. Bu şartların birçoğu sağlık şartları olmakla birlikte pek çok hukukî şart da vardır. Bu anlamda özel güvenlik görevlileri istihdam süresi içerisinde getirilmiş bu şartları kaybedebilirler. Çalışmamızda özel güvenlik görevlisi olmak üzere ne gibi şartların var olduğu ve şartların kaybedilmesi durumunun getireceği muhtemel hukuki sonuçlar açıklanmaya çalışılmıştır.
