The Concept of skilled person in the art, as defined in turkish patent law

Abstract
This article is about establishing if the subject matter of an invention that happens to be the subject matter of an action for the invalidity of a patent or of an application for the registration of a patent does or does not comprise the inventive step. The substantial examination is made by a person of average intelligence, who is neither a genius nor a mediocre technician, and who is knowledgeable and follows the developments in that particular technical field.

Bu makalenin konusu patent hükümsüzlüğü davası veya patent tescil başvurusuna konu olan patentin koruma konusu olan buluş konusunun buluş adımı içerip içermediğinin belirlenmesi hakkındadır. Esaslı incelemeyi ilgili teknik alanı bildiği ve gelişmeleri takip ettiği kabul edilen, ne bir dahi ne de sıradan bir teknisyen olan ortalama zekalı uzman icra etmektedir.
