Abstract
One of the most important principles of the rule of law is to ensure the basic principles of the criminal liability. Taking into consideration of the constitutions, which are the basic law drafts in the legislative hierarchy about protecting the basic rights, freedoms and persons rights, the rectification of the criminal liability in constitutions becomes important. In this article, the approach of the 1982 Constitution to the subject is generally evaluated under the frame work of the court decisions.

Hukuk devleti ilkesinin en önemli öğelerinden birisi ceza sorumluluğuna ilişkin temel ilkelerin güvence altına alınmış olmasıdır. Anayasaların kişi hak ve hürriyetlerinin korunması konusunda temel yasa metinleri ve normlar hiyerarşisi içinde de en üstün kaynak olmaları göz önüne alındığında, ceza sorumluluğuna ilişkin değerlerin anayasalarda düzenleniş şekli önem kazanmaktadır. Bu makalede genel anlamda yargı kararları ışığında 1982 Anayasasının konuya yaklaşımı değerlendirilmiştir.
