IN THE LIGHT OF THE OTTOMAN MASHĪKHAT FATWAS, THE RELATIONS BETWEEN MUSLIMS AND NON-MUSLIMS IN ISTANBUL

Abstract
As the capital city of the Ottoman State, Istanbul is a city in which different cultures and faiths coexist. In this city, Muslims, Jews and Christians have been lived together in peaceful coexistence for centuries. However, sometimes various problems have arisen between them and solutions to these problems have been sought. The present study attempts to deliberate upon the mentioned coexistence, its dimensions, the problems encountered and the solution recommendations. In the light of the fatwas issued by the office of the mashikhat that is the foremost responsible for the interpretation and the formation of the Ottoman Law, the theme has been dealt with, and by the method of exemplification, it has been endeavoured to provide a general standpoint of the theme.
Özet
Osmanlı Devleti’nin başkenti olarak İstanbul farklı kültür ve inançların en üst düzeyde bir arada yaşadığı bir şehirdir. Bu şehirde Müslümanlar, Yahudiler ve Hıristiyanlar asırlarca bir arada yaşamışlar, bunun doğal sonucu olarak aralarında çeşitli problemler oluşmuş ve bu problemlere yetkili makamlar nezdinde çözümler aramışlardır. Bu çalışmada işte bu birliktelik, birlikteliğin boyutları, karşılaşılan problemler ile çözüm önerileri ve metotları üzerinde durulmaya çalışılmıştır. Osmanlı hukukunun yorum ve oluşumunda birinci derecede sorumlu makam olarak Meşihat-ı İslâmiye (Şeyhalislâmlık kurumu) tarafından verilen fetvâlar ışığında konu ele alınmış, örneklendirme yöntemi ile konu hakkında genel bir bakış açısı sağlanmaya çalışılmıştır.
