Abstract

More than any other civil servants, Judges and State Prosecutors wield the ultimate state power and exercise broad discretionary authority. Common Law and Continental European countries use different sources for judicial recruitment. Therefore, qualifications of individuals appointed to judicial offices warrant a modern comparative law examination in order to reform of Turkish judicial career system.

Özet

Hakim (ve savcı) devletin buyurma gücünü azami ve en geniş takdir hakkı ile kullanan kamu görevlileridir. Hal böyle iken, bu statüleri işgal eden kişilerin niteliklerinin mukayeseli ve çağdaş bir bakış açısı ile irdelenmesi elzemdir. Common Law ve Kıta Avrupası ülkerinin hakim (ve savcı) istihdamı için farklı yöntemler uygulamaktadırlar. Türkiye’nin ceza, medeni ve idari yargı mekanizmasının dönüştürülebilmesi için, hakim ve savcı niteliği meselesi acilen çözülmelidir.
