THE PLACE AND EFFECTS OF MONEY-LIKE DOCUMENTS DURING THE TRANSITION TO PAPER-MONEY IN THE OTTOMAN EMPIRE

Abstract

Although the Ottoman Empire faced instability in the economy from time to time, such as fund renewal (tajdid) and money adulteration (deprecation), the existing monetary regime did not change until the Tanzimat Period. In the Tanzimat era, the need for money reached a level that could not be covered by traditional methods due to internal revolts and wars, reforms and payment dates of the previously received debts. The aim of our study is to reveal the reasons and the consequences of the legal proceedings and the reasons why the government considered borrowing money as a right method to get out of the difficult situation. Moreover, these documents were converted into paper and the existing coins were destroyed. In our research, first of all, one of the Ottoman Empire, “national / ottoman system” based on “akçe”; the other, the “foreign / commercial” binary currency system based on the “kuruş” (foreign currency silver coin), followed the base printed in three stages. Since our research is a legal history study, legal regulations related to the subject are also mentioned. It is a fact that the paperwork (money/government note) is not a common practice accepted voluntarily. This makes us think the reasons for this acceptance from legal and historical perspectives.

Özet

Osmanlı Devleti’nde başından beri ekonomik istikrarsızlıklar nedeniyle akçe tecdidi ve tağşişi (yenileme ve değerini düşürme) gibi münferit denebilecek uygulamalar yapılmışsa da madenî para rejimi Tanzimat’a kadar değiştirilmemiştir. Tanzimat devrinde isyanlar, savaşlar, yenilikler ve önceden alınan borçların ödeme tarihlerinin gelmesi gibi nedenlerle para ihtiyacı geleneksel yöntemlerle kapatılamayacak seviyeye çıkmıştır. Çalışmamızın amacı devletin bu zor durumdan kurtulmak için bir borç alma yöntemi olarak düşündüğü kâime adı verilen kâğıtları tedâvüle çıkarmasının nedenleri ve hukukî işlemler bakımından doğan sonuçlarıdır. Bu evrak, sonradan kâğıt paraya dönüştürülerek mevcut madenî para sistemini değiştirmiştir. Çalışmamızda öncelikle Osmanlı Devleti’nin biri, akçe esası üzerine kurulu “millî/osmanî”; diğeri, kuruş (ecnebi gümüş sikke) esasına dayanan “yabancı/ticarî” ikili para sistemi, ardından üç aşamada basılan “kâime” ele alınmıştır. Araştırmamız bir Hukuk Tarihi çalışması olduğundan konuyla ilgili hukukî düzenlemelere de değinilmiştir. Evrâk-ı nakdiyyenin bir günde ve gönüllü olarak kabul edilen bir uygulama değil ekonomik şartlar yüzünden ve tedricen girilen bir iç borçlanma süreci olması, bunun tarihî ve hukukî bir olgu olduğunu düşündürmektedir.
