(Authority of police about the usage of weapons and the right to life)

Abstract
The right to life is a basic human right and is considered to be the condition for existence of all liberties and rights. In a democratic state, governed by rule of law, the state has an obligation to protect the people living under its jurisdiction. In this regard, the circumstances in which the police can use force and weapons should be defined, limited, and controlled by law. There are times when the police use fatal force. This is why an effective and proper system must be developed to avoid the misuse and arbitrary use of force, as well as preventable accidents. The conditions legitimizing the breach of right to life should not be interpreted broadly.
Özet
Yaşam hakkı tüm hak ve özgürlüklerin varlık koşulu olarak temel insan haklarındandır ve demokratik bir hukuk devletinde devlet, yetki alanındaki kişilerin yaşam hakkını korumakla yükümlüdür. Bu bağlamda, kolluk görevlilerinin hangi şartlarda zor ve ateşli silah kullanabileceklerine ilişkin koşulların kanunla düzenlenmesi, sınırlandırılması ve denetlenmesi gereklidir. Kolluk görevlilerinin bazı durumlarda silah kullanma yetkisi kapsamında ölümcül güç kullanması da söz konusu olabilmektedir. Bu nedenle gücün kötüye ve keyfi olarak kullanılmasına, hatta önlenebilir kazalara karşı uygun ve etkin bir güvence sistemi geliştirilmelidir. Yaşam hakkından yoksun bırakılmayı haklı gösteren koşullar katı şekilde yorumlanmalıdır.
