(Rigths of the defender)

Abstract

In this study, the notion of the defender and the independence of the defender shall be discussed. The independence of the defender is impor tant from the point of exercising the rights of the defender. For a successful defence, it is obligatory to protect the defence from all pressure. Subsequently, rights of the defender shall be examined and the subject matter shall be analy- sed in view of the interpretation of the European Court of Human Rights.

Özet

Bu çalışmada müdafiin hakları incelenirken öncelikle müdafi kavramı ve müdafiin bağımsızlığı ele alınacaktır. Müdafiin haklarını kullanması açısından müdafiin bağımsızlığı önem taşımaktadır. Zira müdafiin her türlü baskıdan uzak bulunması savunmanın başarıya ulaşması için esastır. Daha sonraki bölümde müdafiin hakları tek tek incelenecek ve en son bölümde de müdafiin haklarını kullanabilmesinin önemi ve özellikle Avrupa İnsan Hakları Mahkemesi’nin yaklaşımı değerlendirilecektir.
