Abstract
In this article, defective performance types, which may give rise to the joint and several liability of a seller, a producer, and/or an importer based on a consumer contract under the Turkish Code of Consumer Protection (Act. No. 6502) are examined. In this context, alternative rights of a consumer due to defective performance, and the use restrictions on those rights, statute of limitations, and relevant rules of evidence are analyzed.
Özet
Bu makalede 6502 sayılı Tüketicinin Korunması Hakkında Kanun'da (TKHK) öngörülen tüketici sözleşmesine dayalı mal sağlama durumunda, satıcının ve müteselsilen üretici ve ithalatçının sorumluluğunu doğuran ayıplı ifa halleri incelenmiştir. Söz konusu sorumluluk doğuran haller incelenirken tüketicinin ayıplı ifadan kaynaklanan seçimlik hakları ve bu hakların kullanılmasına ilişkin sınırlamalar, ayıplı ifa durumunda uygulanacak zamanaşımı süresi ve ispat kuralları da irdelenmiştir.
