DISTANCE CONTRACTS UNDER THE CONSUMER PROTECTION LAW

Abstract

6502 numbered current "Law on Consumer Protection" ("TKHK") went into effect on the date of May 28, 2014. Following this, "The Regulation on Distance Contracts" ("MSY"), which regulates the application of procedures, and principles, was published on the Official Gazette on November 27, 2014, and it went into effect on February 27, 2015. In this paper, distance contracts, are examined in great detail both within the scope of the current "TKHK", and also within the scope of the MSY regulations. Application of TKHK's Article 48 on distance contracts, and the requisite conditions for its application; pre notification under distance contracts; use of right of withdrawal and its ramifications; performance of the distance contract; delivery and the passing of the damages, are some of the subjects that are examined on this paper

6502 sayılı yeni "Tüketicinin Korunması Hakkında Kanun" ("TKHK")28 Mayıs 2014 tarihinde yürürlüğe girmiştir. Bunun üzerine mesafeli sözleşmelere ilişkin uygulama usul ve esaslarını düzenleyen "Mesafeli Sözleşmeler Yönetmeliği" ("MSY") 27 Kasım 2014 tarihinde Resmi Gazetede yayımlanmış olup, 27 Şubat 2015 tarihinde yürürlüğe girmiştir. Bu makalede mesafeli sözleşmeler, gerek yeni TKHK gerekse MSY'deki düzenlemeler kapsamında ayrıntılı olarak ele alınmıştır. Çalışmada TKHK'nun mesafeli sözleşmelere ilişkin 48. maddesinin uygulanabilmesi için aranan şartlar, mesafeli sözleşmelerde ön bilgilendirme, cayma hakkının kullanımı ile sonuçları, mesafeli sözleşmenin ifası, teslimat ve hasarın geçiş anı gibi konular incelenmiştir
