Abstract

Constitutional Amendment of 2017 in our country is a current example of "deparliamentarization" as an initiative that excludes the Grand National Assembly of Turkey from the political decision-making process. The aforementioned constitutional amendment provides a new system of government under the name of the Presidential System of Government and has formed a structure based on the superiority of the executives by not including check and balance mechanisms between the legislative, executive and judiciary powers as required by the principle of the separation of powers. Deparliamentarization is a fundamental component of this structure; it has been adopted and put into practice as a method that will give the executives power and efficiency. The Grand National Assembly of Turkey has lost significant powers in legislative, audit, representation and budget areas, and its impact on political decision-making processes weakened with the Constitutional Amendment of 2017. For one thing, the Turkish Grand National Assembly had a monopoly of representation but now lost this monopoly because of the reason that the president elected by the people and became the only element of the executive power as a result of the constitutional amendments of 2007 and 2017. Secondly, the legislative powers weakened. The President may issue a decree without being based on law and without obtaining authorization/approval from the legislature provided that it is not contrary to the law. The President has the authority to make any regulation with the decree-laws that will be issued during the emergency state, and these regulations shall not be subject to the judicial review. The audit function of the legislature has also weakened. The motion of censure removed. Although it is not impossible, the parliamentary investigation became extremely difficult. Lastly, the budget authority of the legislature has been taken away.

Özet

Ülkemizde 2017 Anayasa değişikliği, TBMM’ni siyasal karar süreçlerinden dışlayan bir girişim olarak “parlamentosuzlaştırma”nın güncel bir örneğini oluşturmaktadır. Anılan Anayasa değişikliği, Cumhurbaşkanlığı Hükümet Sistemi adı altında yeni bir hükümet sistemi öngörmüş ve kuvvetler ayrılığı ilkesinin gereği olarak yasama, yürütme ve yargı kuvvetleri arasında olması gereken fren ve denge mekanizmalarına yer vermeyerek, yürütmenin üstünlüğüne dayalı bir yapı oluşturmuştur. Parlamentosuzlaştırma, bu yapının temel bir bileşenidir; yürütmeye güç ve etkinlik kazandıracak bir yöntem olarak benimsenmiş ve uygulamaya konmuştur. 2017 Anayasa değişikliği ile TBMM yasama, denetim, temsil ve bütçe alanlarında önemli yetki kaybına uğratılmış, siyasal karar süreçlerindeki etkisi zayıflatılmıştır. Bir kere, TBMM temsil tekeline sahip iken artık 2007 ve 2017 Anayasa değişiklikleri neticesinde Cumhurbaşkanın halk tarafından seçilmesi ve yürütmenin biricik unsuru haline getirilmesi nedeniyle bu tekeli kaybetmiştir.İkincisi, yasama yetkileri de zayıflatılmıştır. Cumhurbaşkanı yasaya dayanmaksızın ve meclisten yetki/onay almaksızın yasaya aykırı olmamak koşuluyla kararname çıkarabilecektir. OHAL sürecinde de çıkaracağı kanun hükmünde kararnameler ile istediği düzenlemeyi yapabilecek ve bu düzenlemeler yargı denetimine tabi olmayacaktır. Meclisin denetim fonksiyonu da zayıflamıştır. Gensoru denetimi kaldırılmıştır. Meclis soruşturması imkânsız olmasa da aşırı ölçüde zorlaştırılmıştır. Son olarak Meclisin bütçe yapma yetkisi elinden alınmıştır.
