Hearing in administrative law

Abstract

Hearing is an exemption of written trial procedure in administrative law. In Turkish administrative law hearing should be held according to procedure. If the parts want “hearing” from first step Courts, the Courts must accept this demand. The parts clarify the petition written to open a file. If the other pats accepts it they are allowed to give new information and document as evidence. But the parts are not allowed to widen and change the subject of the case. The Judge has the right to question the parts in frame of his/her authority. Even if it‟s necessary to hear the witnesses, it is not allowed to hear witness and to administer an oath. The parts have right to speak twice during the hearing. Prosecutor tails part the hearing taken in DanıĢtay (Council of State). “Hearing” is not sufficient and fruitful in administrative law. It should be arranged again to make it effective.

Özet

Duruşma, idarî yargılamanın yazılılığı esasının bir istisnasıdır. Türk idarî yargı-sında duruĢma belli kayıt ve Ģartlara tâbidir. Alt derece yargı yerlerinde taraflar duruĢma talebinde bulunursa, mahkeme duruĢma yapmak zorundadır. DuruĢma-da, taraflar, daha önce dilekçelerinde söylediklerini açıklarlar. Eğer karĢı taraf muvafakat ederse yeni bilgi ve belge sunabilirler. Ancak taraflar dava konusunu geniĢletmezler ve değiĢtiremezler. Hâkim, resen araĢtırma yetkisi çerçevesinde, duruĢmada soru sorabilir (özellikle kamu düzenini ilgilendiren konularda). Ba-zen çok ihtiyaç duyulsa da duruĢmada tanık dinlenemez ve yemin teklif edile-mez. DuruĢmada taraflara sırasıyla iki kere söz verilir. DanıĢtay‟daki duruĢma-larda savcı da bulunur. O da dinlenir. Ġdarî yargıda duruĢma, yeterli ve verimli değildir. Yeniden düzenlenerek etkin hale getirilmelidir.
