The high council of judges and prosecutors and judicial councils in some eu member states

Abstract
The High Council of Judges and Prosecutors is one of the basic issues of the constitutional amendments introduced in 2010, and it was discussed by a large segment of the society before the amendments. There are still certain criticisms on the new structure of the HCJP in view of introduction of judicial review against its decisions and of continuation of the presence of Justice Minister and his undersecretary in the Council.This essay is a work to examine the current and previous structure of the HCJP in parallel with relevant international documents and the high councils in some selected EU Member States. In addition, assessments made in some reports and documents devised in the EU membership process in relation to Turkish HCJP are elaborated and commented.Criticisms and recommendations, raised in advisory visit reports, progress reports and pre-accession reports prepared in the EU approximation process of Turkey, were taken into consideration in establishing the new structure of the HCJP.The elaborated European models and international documents including especially Venice Commission, Solidarity Council of European Judges and European Judicial Network illustrate that the new structure of the Council is similar to its European counterparts and it is compatible with common principles mentioned in said documents to a great extent.The new structure led to abolishment of some powers of the Ministry of Justice, to decreasing influence of the undersecretary in the Council, to independent secretariat and budget and building and to attachment of the Inspection Board to the Council.Hence, the Council became independent vis-a-vis the influence of legislative and executive branches. Principles of broad-based representation and membership diversity were adopted, as a result of which the Council acquired more suitable structure to protect personal independence.The structure of the Council is still new and application results have not been fully obtained. This new structure of the Council has a characteristic served to strengthen the judicial indepedence and impartiality and to decrease the influence of the executive branch on the Council and to improve the rule of law.

Hâkimler ve Savcılar Yüksek Kurulu (HSYK), 2010 yılında yapılan Anayasa değişikliğinin en temel konularından birisidir ve bu değişiklik öncesinde toplumun büyük bir kesimi tarafından tartışılmıştır. Kararlarının yargısal denetime açılması, Adalet Bakanı ve Müsteşarının Kurulda varlığını devam ettirmesi gibi hususlar bakımından HSYK'nın yeni yapısına yönelik bazı eleştiriler de bulunmaktadır.Bu makale, HSYK'nın mevcut ve eski yapısını ilgili uluslararası belgeler ve seçilen bazı Avrupa Birliği ülkelerindeki yargı kurulları paralelinde ele alan bir çalışmadır. Ayrıca, Avrupa Birliği sürecinde, ülkemizle ilgili bazı belge ve raporlarda HSYK ile ilgili yapılan değerlendirmeler irdelenmiş ve yorumlanmıştır.HSYK'nın yeni yapısının oluşturulmasında, Avrupa Birliğine uyum sürecinde Ülkemize yönelik hazırlanan istişari ziyaret raporları, ilerleme raporları ve katılım öncesi tavsiye raporları ile diğer belgelerde geçen eleştiriler ve tavsiyeler dikkate alınmıştır.İncelenen Avrupa modelleri ve başta Venedik Komisyonu, Avrupa Yargıçları Dayanışma Kurulu ve Avrupa Yargı Kurulları Ağı (AYKA-ENCJ) olmak üzere uluslararası belgeler göstermektedir ki Kurulun yeni yapısı muadil AB ülkeleriyle benzeşmekte, sözü edilen belgelerde belirlenen ortak prensiplerle büyük oranda örtüşmektedir.Adalet Bakanlığının bir kısım yetkilerinin kaldırılması, Müsteşarın Kuruldaki etkisinin azaltılması, Kurulun kendisine bağlı bir sekretarya ve bütçesi ile binasının olması, Teftiş Kurulunun Kurula bağlanması yeni yapının oluşturulmasıyla sağlanmıştır.Böylece, Kurulun yasama ve yürütmenin etkisinden uzak, bağımsız bir yapının tesis edilerek geniş tabanlı temsil ve üye çeşitliliği esasının benimsenmesi, bu sayede bireysel bağımsızlıkları korumaya daha elverişli bir yapıya sahip olması sağlanmıştır.Kurulun yapısı henüz yenidir ve uygulama sonuçları da tam olarak elde edilememiştir. Hâkimler ve Savcılar Yüksek Kurulunun bu yeni yapısı; yargı bağımsızlığını güçlü kılan, yargının tarafsızlığını geliştiren, yürütmenin Kurul üzerindeki etkisini azaltan,hukuk devletinin güçlendirilmesine hizmet eden bir niteliktedir.
