Abstract

The fact that the right to publish official announcements is determined by the Press Announcement Association may seem contrary to freedom of press at first sight. With respect to granting the right to publish official announcements, the experiences gained from past to present indicate that this right is deemed as an indispensable income for periodicals. Objective criteria and transparency should be dominant in determination of the periodical about which the right to publish an official announcement shall be granted. By explaining the history of official announcements, constitution and function of the Press Announcement Association and the content of freedom of press, considering the fact this freedom is guaranteed by international securities and Constitution, whether the right to publish official announcements has relevance to freedom of press or not will be clarified

Resmi ilan yayınlama hakkının Basın İlan Kurumunca belirleniyor olması ilk bakışta basın özgürlüğüne aykırı görünebilir. Resmi ilan yayınlama hakkının verilmesi konusunda geçmişten günümüze yaşanılan tecrübeler göstermektedir ki; bu hak süreli yayınlar için vazgeçilemez bir gelir kabul edilmektedir. Resmi ilan yayınlama hakkı verilecek süreli yayının belirlenmesinde objektif kriterler ile şeffaflığın hakim olması gerekir. Resmi ilanın tarihçesi, Basın İlan Kurumunun oluşumu, işlevi ve basın özgürlüğünün uluslar arası güvenceler ve Anayasa ile teminat altına alındığından hareketle bu özgürlüğün içeriği anlatılarak, resmi ilan yayınlama hakkının basın özgürlüğü ile ilintisi olup olmadığı açıklığa kavuşacaktır
