Institutionalisation of judiciary in democratic states based on rule of law

Abstract

The study focuses on the question about how the judiciary, which plays a vital role in the operation of a democratic state based on the rule of law, should function and be established to carry out such determined role. In this study, the court systems with divided juristictions based on ratione materiae which are mostly established in Continental Europe and a single-unified court system that mostly exists in common law tradition are considered; and that which of these two are to be preferred according to the scheme that meets the requirements of a fair, impartial, and an independent judiciary will also be explored. In this context, after the examination of the historical process in the institutionalisation of the judiciary in Turkey, the debates over this process have been assessed in the light of the information provided by the comparative law studies. Finally, the purpose of this study is to determine in what way a fair, impartial, and independent judiciary, which is one of the main characteristics of, and amust for, a democratic state based on the rule of law, should be so structured and operated as to comply with such characteristics and functions.

Özet

Bu makalede, demokratik hukuk devletlerinde, en yaşamsal kurum ve devletin temeli olan yargının nasıl kurumsallaşması ve çalışması gerektiği üzerinde durulmaktadır. Özellikle demokratik ülkelerde her ikisi de uygulama imkanı bulan, yargı ayrılığı ve yargı birliği sistemleri irdelenmekte ve bunlardan hangisi adil, tarafsız ve bağımsız yargı için tercih edilmelidir? sorusuna cevap aranmaktadır. Bu bağlamda, ülkemizde yargının kurumsallaşması konusunda tarihsel ve teorik bilgiler verilmiş ve bu bilgiler karşılaştırmalı hukuk verileriyle birlikte değerlendirilerek sonuçları ortaya konulmaya çalışılmıştır. Özet olarak bu çalışmanın amacı, demokratik hukuk devletinin özelliği ve gereği olarak bağımsız, tarafsız ve adil olması gereken yargının, bu temel özellikler doğrultusunda ne şekilde kurumsallaşması, örgütlenmesi ve çalışması gerektiğini araştırmaktır.
