The right to complain and the renounce complaints authority of minors

Abstract
Complaint as a right is regulated in the 36th and 74th articles of the Constitution; complaint as an adjudication requirement is regulated in the 73rd article of the Turkish Criminal Law (TCL) number 5237 and 158th article of the Criminal Procedure Law (CPL) number 5271. Since complaint is an adjudication requirement that has an application field in both investigation and prosecution phases, TCL used the concept of crimes in which the investigation and prosecution is complaint dependent . In the criminal proceedings, the ex officio prosecution of crimes is the rule and complaint is an exceptional situation. For this reason, if the investigation and prosecution of the crime is not stated to be subject to complaint by the law, the proceedings against the crime will be carried out ex officio.The use of complaint right, which is considered among rights tightly linked to the person, personally by the right owner is the rule; as is the authority to renounce from complaining to be used in person who has the right to complain. Yet, since there is no clear regulation whether minors have the right to use their complaint right and the authority to renounce complaints, this issue is debated in doctrine and application. While searching the convictions of the Higher Court about this issue, it is not possible to speak of ensuring the unity in application because of different convictions. In our study, after briefing the definition and characteristics of complaint right, the opinions and discussions about the use of complaint right and renounce authority by minors in doctrine and application will be handled, and assessments within the context of Supreme Court convictions will be made and our personal opinion will be stated.
Özet
Şikayet, bir hak olarak Anayasamızın 36. ve 74. maddelerinde; bir muhakeme şartı olarak ise, 5237 sayılı Türk Ceza Kanunu (TCK)nun 73. maddesi ile 5271 sayılı Ceza Muhakemesi Kanunu (CMK)nun 158. maddelerinde düzenlenmiştir. Şikâyet, hem soruşturma hem de kovuşturma aşamasında uygulama alanı bulan bir muhakeme şartı olduğundan TCK,Soruşturulması ve kovuşturması şikâyete bağlı suçlar kavramını kullanmıştır. Ceza yargılamasında suçların resen kovuşturulması kural olup; şikâyet, istisnai bir nitelik taşımaktadır. Bu nedenle, Kanunda, suçun soruşturma veya kovuşturmasının şikâyete tabi olduğu belirtilmediği sürece suçla ilgili takibat resen yapılacaktır. Kişiye sıkı sıkıya bağlı haklar arasında yer alan şikâyet hakkının bizzat hak sahibi tarafından kullanılması kuraldır. Aynı şekilde vazgeçme yetkisi de kural olarak şikâyet hakkına sahip kimseye aittir. Ancak küçüklerin şikâyet hakkını kullanmaları ve şikâyetten vazgeçme yetkisine sahip olup olmadıkları konusunda ceza mevzuatımızda açık bir düzenlemeye yer verilmediğinden, bu konu öğreti ve uygulamada tartışmalıdır. Yüksek Mahkemenin konuya ilişkin içtihatları irdelendiğinde, farklı içtihatlar nedeniyle uygulamada da birliğin sağlandığından söz etmek mümkün değildir. Çalışmamızda, şikâyet kavramının tanımı ve özelliklerine kısaca değindikten sonra küçüklerin şikâyet hakkını kullanmaları ve şikâyetten vazgeçme yetkileri konusunda öğretideki görüş ve tartışmalar ele alınacak, Yargıtayın konuya ilişkin içtihatları çerçevesinde değerlendirmeler yapılarak konuya ilişkin şahsi kanaatimiz belirtilecektir.
