“Prohibition of abuse of fundamental rights and freedoms” in the decisions of the constitutional court of Turkey Y

Abstract
The rule of “prohibition of abuse of fundamental rights and freedoms” was first enacted in Article 11 of the 1961 Constitution, and is now in force under Article 14 of the 1982 Constitution. In both documents, this rule appears in sections that lay out basic rights and obligation and include principles for their exceptional restriction. In practice, however, the implementation of the rule has drawn a profile of restriction against human rights with the excuse of protecting the state. As a result, this rule has not served to shield individuals from each other, but the state from people. This paper analyzes the decisions of the Constitutional Court of Turkey, especially through cases of freedom of speech and dissolution of political parties, in which this rule has become an object of abuse.
Özet
Hak ve özgürlüklerin kötüye kullanılması yasağı, önce 1961 Anayasası’nın 11. maddesinde ve daha sonra da 1982 Anayasası’nın 14. maddesinde yer almıştır. Bu yasak, her iki Anayasada da temel hak ve ödevler bahsinde düzenlenmiş ve sınırlama rejimi ile birlikte ele alınmıştır. Ayrıca Anayasalarda yer aldığı şekliyle bu yasak, temel hak ve özgürlükleri korumayı değil, sınırlamayı esas almış ve temel amacı devleti korumak olmuştur. Bu yasağın öznesinin birey, korunması hedeflenenin ise devlet olmasının bir sonucu olarak Anayasa Mahkemesi hak ve özgürlüklerin kötüye kullanılması yasağını başta ifade ve siyasi parti özgürlükleri olmak üzere pek çok anayasal hak ve özgürlüğün sınırlandırılmasında kullanmıştır.
