Electronic Evidence (E-Evidence) Concept from the perspective of Evidence Law in Criminal Prosedure

Abstract
The purpose of criminal procedures is to reveal the material facts. In order for thispurpose to be realized, the principle of freedom of evidence has been accepted. Asper the freedom of evidence, everything can be used as evidence so as to reveal thematerial facts, provided that they are obtained lawfully. The assesment of electronicevidence in terms of law of evidence is the subject of this study, as the modern crim- inal procedure shows the tendency of reaching the material fact by using scientificevidence. However; in spite of the ever-growing importance and usage rate of the information tecnologies in human life, the lawmaker does not make any law corcern- ing electronic evidences. In order to determine how the authorities are to act whenencountered as usual with the electronic evidence, the concept in question will beexamined by focusing on theories and practice.
Özet
Ceza muhakemesinin amacı maddi gerçeğin ortaya çıkartılmasıdır. Bu amacıngerçekleştirilebilmesi bakımından ceza muhakemesi hukukunda delil serbestisi ilke- si benimsenmiştir. Delil serbestisi ilkesi uyarınca hukuka uygun olarak elde edilmişve maddi gerçeğin ortaya çıkartılmasına yarayacak her şey delil olarak kullanılabil- mektedir. Bu çalışmanın konusunu da delil ve ispat hukuku açısından elektronik delil(e-delil) kavramının değerlendirilmesi oluşturmaktadır. Zira modern ceza muhakeme- si hukukunda eğilim, maddi gerçeğe ulaşılması için bilimsel delil aşamasına geçilmesiyönündedir. Bununla birlikte bilişim teknolojilerinin insan hayatındaki gün geçtikçeartan önemine rağmen kanunkoyucu elektronik deliller konusunda hüküm tesis etmişdeğildir. Elektronik deliller ile sürekli olarak karşı karşıya gelen muhakeme makamla- rının bu deliller hakkında nasıl hareket edeceğinin tespit edilebilmesi bakımından sözkonusu kavram teori ve uygulamadaki görüşler doğrultusunda ortaya konulacaktır.
