Trademark License Agreements

Abstract

Licence agreements have the basis of their contractual item touchpoints with in- tellectual property laws on special.Although the licence agreement terms are not fully regulated by legislation, thereare a few articles regarding trademark licence agreements in the 556 numbered Sta- tuory Decree of Protection of Trademarks. This study analyses Trademark License Agreements in the light of Turkish legislati- on and practice including jurisprudential doctrine. Trademark licence agreement is one of the various licence agreements. By contra- cting licence agreement, licensee shall have the usage rights of the trademark. Mostimportantly, the licensor retains the ownership of the trademark during the life of thecontract

Özet

Lisans sözleşmelerinin, sözleşme konusu itibariyle, bir çok özel kanunla bağlantınoktası bulunmaktadır. Marka lisans sözleşmesi tüm unsurlarıyla kanunda düzenlenmiş bir sözleşme de- ğildir. Ancak 556 sayılı Markaların Korunması Hakkında Kanun Hükmünde Kararna- mede marka lisans sözleşmesi ile ilgili bazı düzenlemelere yer verilmiştir. Bu çalışma esas itibariyle Türk marka mevzuatı ve uygulama ile hukuk öğretisininışığı altında Marka Lisans Sözleşmelerini incelemektedir. Marka lisans sözleşmesi, lisans sözleşmesi türlerinden biridir. Marka lisans sözleş- mesi ile lisans alan, markanın kullanım hakkını elde etmektedir. Marka lisansının enönemli özelliği markanın mülkiyetinin lisans verende kalmasıdır
