Abstract

Turkish Commercial Code numbered 6102 adopted the concept of the modernsystem in commercial affairs. Despite this situation the concept of merchant is im- portant in the Turkish Commercial Code system. For example, the definition of affairsdone in the commercial business while merchants are considered. The tradesmanis used in the determination of the concept of commercial enterprises. Commercialenterprises operating in the person s knowledge is important. In our study, which willfocus on natural and legal persons will be considered by merchants. Then it will betaken to realize how real and legal persons in the acquisition of the tradesman andthe lost. There will also be referred to the distinction between traders and artisans.These studies are conducted and how will examine the doctrine discussed in the lightof the Supreme Court decision tradesman

Özet

6102 sayılı Türk Ticaret Kanunu ticari işletme kavramını merkez alan modern sis- temi benimsemiştir. Bu duruma rağmen tacir kavramının da Türk Ticaret Kanunununsistemi içinde önemi vardır. Örneğin ticari işin tanımı yapılırken tacirin yaptığı işleresas alınmıştır. Tacir sıfatının tespitinde ise ticari işletme kavramından yararlanılmış- tır. Ticari işletmeyi işleten kişinin bilinmesi önem arz etmektedir. Çalışmamızda hangigerçek ve tüzel kişilerin tacir sayılacağı üzerinde durulacaktır. Daha sonra tacir sıfatınınkazanılması ve kaybedilmesinin gerçek ve tüzel kişilerde nasıl gerçekleşeceği ele alına- caktır. Ayrıca tacir ve esnaf ayrımına değinilecektir. Bu çalışmalar yapılırken doktrin veYargıtay kararları ışığında tacir sıfatının nasıl ele alındığı da incelenecektir
