The applicability of theeuropean convention on human rights to the tax law and tax proceeding: an analysis in the light of the case law of the european court of human rights

Abstract
The paradigm which considers taxation as a civic duty and a matter forms part of the hard core of public authority prerogatives has started to shift recently and a new paradigm which focuses on the tax payers’ human rights is visible now. The jurisdic- tion of the European Convention on Human Rights is an example of the new para- digm. Several rights under the European Convention on Human Rights are applicable in the context of the taxation and tax proceeding. European Court of Human Rights recognizes the tax-surcharge as a criminal charge under Article 6 of the European Convention on Human Rights and accordingly all the guarantees of Article 6 are ap- plicable. Search of the premises and seizure of the documents and telephone tapping in a tax audit constitute a interference with the right to respect to private life, home and correspondence. Moreover, taxation constitutes an interference with the individ- ual and collective dimensions of the freedom of religion. Taxation as an interference with the protection of property is proceeded before the European Court of Human Rights frequently. Prohibition of discrimination, freedom of movement and the right not to be tried or punished twice also have a close link with taxation. Still, European Convention on Human Rights needs to be applied more effectively in the context of taxation. For instance, tax assessment is not recognized as a civil right and obligation in the meaning of Article 6 and it is hard to explain the reason for this.
Özet
Vergilendirmeyi bir vatandaşlık ödevi ve devletlerin mutlak egemenlik alanı için- deki bir husus olarak kabul eden paradigmanın değişmeye ve vergi yükümlülerinin insan haklarına vurgu yapan yeni bir paradigmanın yerleşmeye başladığı bir dönem- deyiz. Avrupa İnsan Hakları Sözleşmesi uygulaması buna bir örnek teşkil etmektedir. Bu Sözleşme’deki çeşitli hakların vergilendirme ve vergi yargılaması bağlamında uygu- lanabilme kabiliyeti bulunmaktadır. Avrupa İnsan Hakları Mahkemesi içtihadı uyarınca idari para cezaları, suç isnadıdır ve adil yargılanma hakkı güvenceleri bu cezalar için de geçerlidir. Vergilendirmeden kaynaklanan konut arama, belgelere el koyma ve iletişi- min denetlenmesi gibi önlemler özelinde özel yaşama, konuta ve haberleşmeye saygı hakkı gündeme gelebilmektedir. Vergilendirmenin, inanç özgürlüğünün hem bireysel hem de kolektif boyutuna bir müdahale teşkil ettiği durumlar da söz konusudur. Ver- gi ayrıca, mülkiyet hakkına müdahale teşkil eden bir işlem olması sebebiyle bu hak bağlamında da sıklıkla gündeme gelebilmektedir. Ayrımcılık yasağı, serbest dolaşım hakkı ve aynı suçtan ötürü iki kez yargılanmama ve cezalandırılmama haklarının da vergilendirmeyle doğrudan bir bağlantısı vardır. Ancak, Avrupa İnsan Hakları Sözleş- mesi’nin vergi yükümlülerinin hakları bağlamında daha etkili bir şekilde kullanılması da beklenmektedir. Örneğin, vergi aslına dair uyuşmazlıklar Avrupa İnsan Hakları Söz- leşmesi md.6 anlamında medeni hak ve yükümlülük olarak kabul edilmemektedir ki, bunun izahı son derece güçtür.
