Proportionality in Self-Defense and the Concept of Stopping Power

Abstract

Self-defense is the protection of person against assault by another. There mustbe proportionality between the severity of the assault and the measure of defense.Mechanisms of gunshot injuiries have very complex character. The mechanism shouldbe known clearly to estimate the proportionality in cases of defense with firearm.Gunshot wound mechanism includes mainly; permanent cavity, temporary cavity andfragmentation. The aim of self-defense is stopping the perpetrator. The lethal wounddoesn t mean stopping wound. The perpetrator is not incapacitated by firearms even fatal wound. In this study, mechanism of gunshot injuries, the concept of stoppingpower were evaluated with Supreme Court decisions.

Meşru savunma kişinin bir saldırı karşısında kendisini korumasıdır. Bu savunmasaldırı ile orantılı biçimde olmalıdır. Ateşli silah yaralanmaları kompleks mekanizma- lardır. Savunma esnasında ateşli silah kullanılan durumlarda orantılılığın değerlendi- rilebilmesi için bu yaralanma mekanizmasının bilinmesi gerekmektedir. Ateşli silahlarkalıcı boşluk, geçici boşluk ve fragmantasyon oluşturarak doku hasarına neden olur- lar. Meşru müdafaada amaç saldırganı durdurmaktır. Bir yaranın öldürücü nitelikteolması durdurucu olduğu anlamına gelmez. Ateşli silahla öldürücü nitelikteki yaralan- maların bile saldırganı etkisiz hale getirmesi mümkün olmayabilir. Çalışmada ateşli si- lah yaralanma mekanizması, durdurucu güç kavramı ve bazı Yargıtay kararları birlikteele alınacaktır.
