The prohibition of torture in fight against terrorism within the scope of human rights and humanitarian law

İnsan hakları hukuk ve insancıl hukuk çerçevesinde terörle mücadelede işkence yasağı

Abstract

One of the greatest enemies of democracy and human rights is undoubtedly ter- rorism. The state which has to maintain peace and order of its citizens is obligated to fight against the terrorism. One of the top questions of today that awaits its answer is what is the method of this war against terrorism and the conditions of it. There is no doubt that every state ruled in terms of modern democracy has its own organized public order units and regulations to fight against criminals. But these two elements are mostly insufficient to war against the terrorism. Because of this, states take col- lateral measures and raise the intensity of this war. This intensity necessarily means that the human rights would be restricted. In this study, this problem is taken based on. At first, the notions of terror and terrorism are examined; and the connection of terrorism to human rights and humanitarian law is briefly mentioned afterwards. As the main subject, the balance between fight against terror and human rights in regards of the right of protection from torture, and inhuman or degrading treatment or punishment in accordance with the jurisprudences of European Court of Human Rights is studied.

Demokrasi ve insan haklarının en büyük düşmanlarından biri kuşkusuz terörizmdir. Vatandaşlarının huzur ve güvenliğini tesis etmek mecburiyetinde olan devlet, terö- rizmle mücadele etmek zorundadır. Çağımızın cevap arayan sorularının başında da bu mücadelenin yöntem ve şeklinin nasıl olacağı gelmektedir. Hiç kuşkusuz modern demokrasiye sahip devletlerin tümünde örgütlü bir asayiş organı ve suçlularla müca- dele etmeye imkân veren mevzuatı vardır. Lakin bunlar çoğu zaman terörle mücadele konusunda yetersiz kalmaktadırlar. Dolayısıyla da devletler ek önlemler almak zorun- da kalmakta ve mücadele gücünü sertleştirmektedirler. Bu sertlik de ister istemez bazı insan haklarının sınırlandırılacağı anlamına gelmektedir. Bu çalışmada da bu problem esas alınmıştır. Öncelik terör ve terörizm olguları değerlendirilmiş; ardından insan hakları, insancıl hukuk ve terörizm ilişkisine kısaca değinilmiştir. Esas konu olarak da Avrupa İnsan Hakları Mahkemesi kararları ışığında İşkence, İnsanlık Dışı ve Onur Kırıcı Muameleden Korunma Hakkı özelinde terörle mücadele-insan hakları dengesi ince- lenmiştir.
