Negligence under the Turkish Penal Code

Abstract

Negligence refers to the realization of the outcome that takes part in the legaldefinition of crime without prediction due to the contrariety to attention and care ob- ligations. As a result of industrialization and social developments, negligent behaviorsthat were not punished in the past were regulated through penal codes and started tobe punished since they led people to be exposed to different kinds of dangers.In the study, the theories with regard to the legal basis of negligence and TurkishPenal Code No. 5237 were discussed in comparison to Turkish Penal Code No. 765.In addition, German Penal Code and the negligence concept in Anglo-Saxon law werementioned in the study. The conditions and types of negligence were evaluated in thelight of Supreme Court decisions

Özet

Taksir, dikkat ve özen yükümlülüğüne aykırılık dolayısıyla suçun kanuni tanımındayer alan neticenin öngörülmeyerek gerçekleştirilmesidir. Önceleri cezalandırılmayantaksirli davranışlar sanayileşme ve toplumsal gelişmeler neticesinde insanların farklıtehlikelerle karşılaşmalarına neden olduğundan ceza kanunlarında düzenlenmiş vecezalandırılmaya başlanmıştır.Çalışmada taksirin hukuki esası bakımından ileri sürülen teoriler ve 5237 sayılı TCKhükmü 765 sayılı TCK ile karşılaştırmalı olarak incelenmiştir. Ayrıca Alman Ceza Kanu- nu ve Anglo Sakson hukukunda taksir kavramından bahsedilmiştir. Taksirin şartları veçeşitleri Yargıtay kararları ışığında değerlendirilmiştir
