Evolution of European Military Criminal Justice Systems from the Perspective of Human Rights and Current Trends

Abstract
It is known that military justice has existed since armies came into being. Military justice varies in terms of functions, composition and operation from one country to another. But a significant number of State have military jurisdiction established in their constitutions, together with regulations relating to their functions, composition and operation. Many of today's military justice systems have greatly evolved since their creation. Military justice systems are reformed to improve their effectiveness, the quality of justice delivered by military courts, and to adapt to the changing domestic legislation, to international standards or specific needs of the military institution. This is inevitable especially in Europe, where the European Convention of Human Rights has had an impact on national military law. This paper examines the evolution of military criminal justice systems and current trends in Europe from human rights perspective.
Özet
Askeri yargının, orduların oluşumundan beri var olduğu bilinmektedir. Askeri yargı, fonksiyonu, yapısı ve görev alanı bakımından bir ülkeden diğerine farklılık göstermektedir. Fakat birçok devlet askeri yargısını, fonksiyonu, yapısı ve görev alanı ile ilgili düzenlemelerle anayasalarına koymuştur. Bugünkü askeri yargı sistemlerinin çoğu, oluşumundan itibaren büyük oranda evrime uğramıştır. Askeri yargı sistemleri, faydalarını ve yargılama kalitelerini artırmak, değişen iç hukuk düzenlemelerine, uluslararası standartlara, askeri kurumların özel ihtiyaçlarına adapte olmak için iyileştirilmektedirler. Bu özellikle, Avrupa İnsan Hakları Sözleşmesi'nin, ulusal askeri yargı hukukuna etki ettiği Avrupa için kaçınılmazdır. Bu makale, askeri ceza yargı sistemlerinin Avrupa'da gelişimini ve güncel eğilimleri insan hakları perspektifinden incelemektedir.
