Abstract

From the classical period to the era of regulations, as an important part of statesystem like muslim citizens, non-muslims took part in legal texts and applications.Doubtedlessly, family law is among these subjects. According to zimmet agreement,right of life, property, and honour and religious freedoms are under the protectionof state in both Ottoman law and İslamic law. In the Ottoman law, which is under theinfluence of İslam because the conception of family is handled in religious context,non-muslim are subject to their own religious and civil rules in parallel with previouspractices. It can also be seen different approaches in the field of family law within thescope of its distinctive economic and political structure both by governers and in theframework of state practises. In this regard, this study discusses such as marriage,divorce, guardianship, heirship and mehir issues spesific to non- muslims within the Non-Muslims In Islam-Ottoman Family Law
