Examination Procedures of Individual Applications in Constitutional Court

Abstract

One of the most important procedural rules in the examination of individualapplications is to examine and conclude applications over documents withoutconducting any hearing. Since the applications are made over files, there is noprocedure to inform the parties as for many proceedings. Due to lack of hearing,a large number of civil and criminal procedures such as going to courts or askingthe opinions of the parties in the face of many information and documents are notimplemented here.Another important procedural rule is that the Constitutional Court (the Court) cancollect information and documents directly from institutions, hear witnesses, apply toviewing and court expert examination although hearing is not available in individualapplications. There is not any rule requiring the Court to notify these information anddocuments to the parties. Where it considers necessary, there is a notification systemto the parties. This closed and non-transparent working system sometimes gives riseto criticisms.In individual applications, examinations should be made starting from the firstregistration according to the sequence of registration. However, the Court can alsomake a different examination sequence in the framework of the criteria set out by itbased on their importance and urgency in respect of their subjects.For example, temporary injunctions and the applications for right to life, right offreedom and security related to detention or the integrity of material and spiritualassets are evaluated as applications which carry importance and urgency. Thus, theyare addressed and examined by giving them more priority when compared to others.One of the most controversial procedural issues regarding the Constitutional Courtconcern the issue as to whether or not the Constitutional Court conducts examinationas a super appeal court. I suppose almost many of us answered this question bystating, It is certainly not a super appeal authority . In fact, there arose a need tosecure this issue both constitutionally and legally and was done so. Nevertheless,when the decisions rendered by the Court are examined, the issue is apparently notwhat it seems.

Bireysel başvuruların incelenmesinde en önemli usul kurallarından birisibaşvuruların duruşma açılmaksızın evrak üzerinden incelenip karara bağlanmasıdır.İncelemeler dosya üzerinden olduğu için çoğu işlemler için tarafların bilgilendirilmesiusulü bulunmamaktadır. Duruşma yokluğu dolayısıyla tarafların mahkemeye gidipgelmeleri veya birçok bilgi ve belgeye karşı tarafların düşüncelerinin sorulması gibibirçok hukuk ve ceza muhakemesi usulü burada uygulanmamaktadır.Diğer bir önemli usül kuralı ise bireysel başvurularda duruşma olmamasınarağmen Anayasa Mahkemesinin (Mahkeme) kurumlardan doğrudan bilgi ve belgetoplayabilmesi, tanık dinleyebilmesi, keşif ve bilirkişi incelemesine müracaatedebilmesidir. Elde ettiği bilgi ve belgeleri taraflara tebliğ etmesi gerektiğine dairbir kural bulunmamaktadır. Gerekli görmesi halinde taraflara tebliğ sistemi vardır.Mahkemenin şeffaf olmayan bu kapalı çalışma sistemi kimi zaman eleştirilere desebebiyet vermektedir. Bireysel başvurularda incelemeler kayıt sırasına göre ilk kayıttan başlanarakyapılmaktadır. Ancak Mahkeme, başvuruların konuları itibarıyla önemine veaciliyetine göre de belirlediği kriterler çerçevesinde farklı bir inceleme sıralaması dayapabilmektedir. Örneğin tedbir kararları ile başvurucunun yaşam hakkına, tutuklulukla ilgiliözgürlük ve güvenlik hakkına veya maddi ve manevi varlığının bütünlüğüne yönelikbaşvurular önem ve aciliyet arz eden başvurular olarak değerlendirilerek diğerlerinegöre öncelikle ele alınıp incelenmektedir. Anayasa Mahkemesiyle ilgili en tartışmalı usül konularından birisi de AnayasaMahkemesinin süper temyiz mahkemesi gibi inceleme yapıp yapmadığı hususudur.Hemen çoğumuz bu soruya elbette Anayasa Mahkemesi süper temyiz mercii değildirşeklinde cevap vermiştir. Aslında bu konu görünüşte hem anayasal hem de yasalolarak güvence altına alınma ihtiyacı hissedilmiş ve güvenceye alınmıştır. AncakMahkemenin verdiği kararlar incelendiğinde konunun hiç de öyle göründüğü gibiolmadığı yönündedir.
