Abstract
2 of the Law 4857 substances with principal employer and the subcontractorrelationship within the scope of the workers labor rights of both employers togetherto be responsible for these responsibilities, the nature with the principal employerand the subconractor of this responsibility welded inside the interactions allocationis required.For determing the responsibility the kind of encumbrance, joint liability withthe provisions of the Code of Obligations regulates, judicial decisions, agreementbetween the parties shows us the way.

4857 sayılı İş Kanununun 2. maddesi ile asıl işveren- alt işveren ilişkisi kapsamındaçalışan işçilerin işçilik haklarından her iki işverenin birlikte sorumlu tutulması, busorumluluğun mahiyetiyle birlikte asıl işveren ile alt işveren arasındaki birliktesorumluluktan kaynaklı iç ilişkinin irdelenmesini de gerekli kılmaktadır. Söz konusu iç ilişkinin belirlenmesinde birlikte sorumlu olunan işçilik alacağınınnevi, müteselsil sorumluluğu düzenleyen Borçlar Kanunu hükümleri ile yargı içtihatlarıve taraflar arasındaki sözleşmeler bize yol gösterici olmaktadır.
