The Applicability of the Right to Fair Trial to Administrative Cases Regarding the Public Servants: The ECtHR's Perspective From Pellegrin (1999) to Baka (2016)

Abstract
Pursuant to article 6/1 of the EuropeanConvention on Human Rights to whichTurkey is a party and which has the forceof law according to Article 90 of theConstitution, everyone is entitled to a fairtrial in the determination of his civil rightsand obligations. However the notion of"civil" mentioned in the article causes ahesitation whether the article 6 of theConvention is applicable to disputes underthe competence of the administrative courtsin our country. With its three differentjudgments delivered in 1999, 2007, and2016, the Grand Chamber of the EuropeanCourt of Human Rights adopted someprinciples which might take that hesitationaway. In this context the principles laid downby the said three judgments of the EuropeanCourt of Human Rights and these principles'effects to the Turkish Administrative Law arethe subjects of this article.
Özet
Türkiye'nin taraf Anayasa'nın 90. maddesi gereğince iç hukukta kanun hükmünde bulunan İnsan Hakları Avrupa Sözleşmesi'nin 6/1. maddesine göre herkes, "medeni hak ve yükümlülüklerinin belirlenmesinde" adil yargılanma hakkına sahiptir. Ancak madde metninde geçen "medeni" ibaresi, ülkemizde idare mahkemelerinin görev alanına giren uyuşmazlıklarda Sözleşme'nin uygulanabilir olup olmadığı hususunda tereddüt uyandırmaktadır. İnsan Hakları Avrupa Mahkemesi Büyük Dairesi, 1999, 2007 ve 2016 yıllarında verdiği üç ayrı kararı ile kamu görevlileriyle ilgili idari uyuşmazlıklar bakımından söz konusu tereddüdü giderebilecek bazı prensipler benimsemiştir. Bu bağlamda İnsan Hakları Avrupa Mahkemesi'nin söz konusu üç kararı ile ortaya konulan prensipler ve bu prensiplerin Türk İdare Hukukuna etkileri bu makalenin konusunu oluşturmaktadır.
