Turkish Jurisdiction on Trans-Boundary Invisible Visual Audio Media Services and State of Emergency Law Decree Regulations Number 690

Abstract
European Media Law, which also originated in our national regulations; In Trans-border AudioVisual Media Services, only one member state has provisions that require jurisdiction and at the same time allow the target country to take binding measures. It is understood that despite the fact that the provisions on jurisdiction have been tried to be left untreated by the bodies of the European Union and Council of Europe and have been prepared through laborious processes, national regulations and judicial precedents are needed in practice. This requirement seems to be felt even more in the Emergency State Legal Regime, in which the public order has deteriorated and measures have to be taken for reestablishment. However, the measures to be taken during the period of Emergency shall not contradict with other obligations arising from the European Convention on Human Rights and international law. The amendments, limitations and innovations brought by Article 2 of the Law No. 6112 on the jurisdiction of the Republic of Turkey, amended by Article 58 of the Decree-Law No. 690, which are expected to bring about these purposes, constitute the subject of this work. In the course of examining the case, the case law of the European Court of Human Rights and the case law of the National Judiciary precedents (Constitutional Court, Council of State, Supreme Court decisions) were taken into consideration.
Özet
Ülkemiz düzenlemelerine de kaynaklık eden Avrupa Medya Hukuku; Sınıraşan Görsel-İşitsel Medya Hizmetlerinde sadece bir üye devlet yargı yetkisinin olmasını isteyen, aynı zamanda hedef alınan ülkenin bağlayıcı önlemler almasına izin veren hükümler içermektedir. Yargı yetkisine ilişkin hükümlerin Avrupa Birliği ve Avrupa Konseyi organlarınca düzenleme boşluğu bırakılmamaya gayret edilen ve zahmetli süreçlerden geçerek hazırlanmasına rağmen uygulamada ulusal düzenlemelere ve yargısal içtihatlara ihtiyaç duyduğu anlaşılmaktadır. Özellikle kamu düzeninin bozulduğu ve yeniden tesisi için önlemlerin alınmasının zorunlu olduğu Olağanüstü Hal Hukuki Rejimlerinde bu ihtiyacın daha da çok hissedildiği görülmektedir. Ancak Olağanüstü Hal döneminde de alınacak önlemlerin Avrupa İnsan Hakları Sözleşmesi ve uluslararası hukuktan doğan diğer yükümlülüklere ters düşmemesi gerekmektedir. Bu amaçlar doğrultusunda düzenlemeler getirmesi beklenen 690 Sayılı Kanun Hükmünde Kararname (KHK)’nin 58. Maddesi ile değiştirilen 6112 Sayılı Kanunun Türkiye Cumhuriyeti yargı yetkisine ilişkin 2. Maddesinin getirdiği değişiklikler, sınırlama ve yenilikler bu çalışmanın konusunu oluşturmaktadır. Konu incelenirken Avrupa İnsan Hakları Mahkemesi içtihatları ile Ulusal Yargı içtihatları (Anayasa Mahkemesi, Danıştay, Yargıtay kararları) göz önünde bulundurulmuştur.
