Psychological Planned Obsolescence and Covid-19*

Abstract

Planned obsolescence is a strategy causing social, economical and environmental damages. It was defined under French Consumer Protection Code, Article L441-2 as “any techniques whereby the entity responsible for the placement of a product on the market deliberately intends to shorten life span in order to increase its rate of replacement.” It has very wide concept since it has different applications in various sectors and has different types such as technological obsolescence, built-in obsolescence, or psychological obsolescence. Even though planned obsolescence was discussed by economists in detail, there is not sufficient studies legally. This article analyses planned obsolescence regarding legal aspects. This work analyses planned obsolescence applications of designing components with unsustainably short lifespan, and releasing new model regularly aiming to obsolete previous model. It assesses increasing online transactions, and replacing collective activities and works by social isolation caused by Covid-19. It is aimed to determine whether there is a connection between the experience of ‘the biggest decrease in demand for smart devices since 2013 in the Covid-19 period this year’ and the perception of “the more consumption the higher social status” or “having certain brand, or new model products is an indicator of socioeconomic status” which are caused by psychological planned obsolescence

Özet

Ürünü piyasaya süren kişilerin ürün ömrünü kasten kısaltmak üzere kullandıkları her türlü teknik olarak planlı eskitme Fransa’da Tüketici Kanunu’nun L441-2 maddesinde tanımlanmıştır. Teknolojik, müdahil veya psikolojik eskitme gibi türleri olan planlı eskitme birçok sektörde farklı uygulamalarla ortaya çıktığından kapsamlı bir konudur; ancak hukuki açıdan yeterince incelenmemiştir. Bu eksikliğin giderilmesini amaçlayan bu çalışmanın kapsamı planlı eskitme türlerinden psikolojik eskitme ile sınırlandırılmıştır. Bu bağlamda belirli aralıklarla yeni ürün piyasaya sürülerek mevcut modelin eskidiği algısı uyandırılması gibi planlı eskitme uygulamaları ele alınmıştır. Mevcut sistemde Covid-19 etkisinde online işlemlerin artması ve toplu aktivitelerin yerini sosyal izolasyonun almasının planlı eskitmeye etkisi sorgulanmıştır. Bu şekilde akıllı cihaz talebinde 2013 yılından itibaren en büyük düşüşün Covid-19 nedeniyle özellikle psikolojik planlı eskitme kapsamında üreticiler tarafından oluşturulan toplumsal statünün tükettikçe yükselmesi algısı yahut belirli marka ve yeni model ürünlere sahip olmanın toplumsal statü göstergesi olduğu algısı arasında bir bağ olup olmadığının tespiti amaçlanmıştır.
