Undercover investigatiors

Abstract

The conception and the method of undercover investigatiors that is been practised commonly for the warfare of organized crime and criminal in Europe and USA, is a new Notion for crime intestigation and trial in our country and is not been practise dentirely at present. The identity changed undercover investigator infiltration to the criminal organization to obtain concrete evidences, provides advantages for the conception of especially huge criminal organizations. The undercover investigator conception, that is a new theme in 5271 numbered CMK, will be fully examinated in this article and undercover investigator conception, historical development, the process and condition of assigning, the protection of confidential investigator as a witness, the evaluation of the evidence obtained by the investigator and criminal liability will be detailed.

Örgütlü suç ve suçluyla mücadelede Avrupa ve ABD’de sıkça uygulanan gizli soruşturmacı kavramı ve yöntemi, ceza soruşturma ve yargılamamız için yeni bir kavram olup, halen tam olarak uygulama alanı bulmuş değildir. Kimliği değiştirilerek, suç örgütüne sızan ve örgüt içerisinden somut kanıtlar elde etmek için faaliyette bulunan gizli soruşturmacı, özellikle devasa büyüklüklere ulaşmış suç örgütleriyle mücadelede büyük avantajlar sağlamaktadır. 5271 sayılı CMK’nın içerdiği yeniliklerden biri olan gizli soruşturmacı kavramı, bu makalede etraflıca incelenecek olup, gizli soruşturmacı kavramı, tarihsel gelişimi, gizli soruşturmacı atama süreci ve koşulları, gizli soruşturmacının korunması, tanık olarak dinlenmesi, elde ettiği kanıtların değerlendirilmesi ve gizli soruşturmacının cezai sorumluluğu gibi konular detaylandırılacaktır.
