Mortgage (Hypotheca) in Islamic Law

Abstract
Mortgage (hypothec) is one kind of the means of real securities which based on something concrete. Mortgage represents the last part of the mortgage collateral law. Concept of mortgage is discussed generally in the classical works of Islamic law. The first period of Islamic jurists have discussed and have evaluated generally the pledge of garden and field. The legal status of the collecting power, gave rise some discussions related mortgage. While lawyers that accept the necessity of collecting power claim that the mortgage is an illegal operation, lawyers that agree that the collecting power is not mandatory claim that the mortgage is a legal operation in the pledge contract. Mortgage is the means of real securities which are often applied in order to maintain confidence in the statutory regulations which made today. With mortgage can reach a legal conclusion about many subject discussed in the classical works of Islamic law
Özet
İpotek, somut bir şeye istinat eden aynî teminat vasıtalarından biridir. İpotek teminat hukukunun son merhalesini teşkil etmektedir. İslâm hukukunun klasik eserlerinde genel olarak ipotek kavramı ele alınmıştır. İlk dönem İslâm hukukçuları bahçe ve tarlanın rehnini ele almış ve genel hatlarıyla değerlendirmeye tâbi tutmuşlardır. Kabzın hukukî durumu, ipotekle ilgili bazı tartışmalara sebebiyet vermiştir. Rehin akdinde kabzın şart olduğunu kabul eden hukukçular ipoteğin geçersiz bir işlem olduğunu iddia ederken, şart olmadığını benimseyenler ise ipoteğin geçerli olduğunu iddia etmişlerdir. Günümüzde yapılan kanuni düzenlemelerde ipotek güvenin sürdürülebilmesi için başvurulan aynî teminat vasıtalarından biridir. İpotekle klasik eserlerde tartışma konusu yapılan birçok meseleyle ilgili hukuki bir sonuca varılabilir
