THE DISCRETIONARY POWER OF THE ADMINISTRATION DURING GOVERNOR APPOINTMENTS ACCORDING TO THE DECISION OF THE COUNCIL OF STATE

Abstract
Procedures pertaining to the appointment of governors, and their assignment to the central office in Ankara, is one of the most debated subjects of the Turkish administrative system. These debates stem largely from discussionsas well as the uncertaintyon how the limits of the central administration s discretionary powers concerning this subject should be delineated, and which aspects of these discretionary powers should be subject to judicial control by judicial bodies. Based on an evaluation of the judicial decisions of the Turkish Council of State (Danıştay), which appears to vary over time and in terms of doctrine, it is possible to identify two main views on this subject. One view holds that governors are exceptional civil servants, and that, due to the political executive authoritythey possess in accordance with the Law on Provincial Administration, the central administration s discretionary power concerning the assignment of governors should be interpreted in a broader sense. For this reason, this view asserts that judicial bodies should only examine administrative procedures relating to the appointment of governors only in terms of authority (i.e. whether the decision has been taken by authorized parties) and due procedure (i.e. whether the proper procedures have been followed). In contrast, the other view claims that the office of the governor represents a civil service performed in accordance with the principles of general administration, and that, consequently, the assignment and dismissal of governors cannot be performed on grounds that are contradictory to the public interest and the requirements of public service. For this reason, this views holds that the reasons and subjects of governor appointments performed by administrative authorities should also be subject to judicial scrutiny.

Vali atama ve valilerin merkez emrine görevlendirilmesi şekli bugün Türk idare sisteminin en önemli tartışma konularından biridir. Bu tartışma esasen bu konuda merkezi yönetime tanınan takdir yetkisinin sınırlarının ne şekilde çizileceği ve takdir yetkisinin idari yargı organlarınca denetimi konusunda işlemin hangi unsuru bakımından denetlenebileceği konusundaki görüş ayrılığından kaynaklanmaktadır. Gerek doktrinde gerekse Danıştay İçtihatları incelendiğinde bu konuda iki farklı görüşün ileri sürüldüğü görülmektedir. Bir görüş valiliğin istisnai memurluk olduğu ve İl İdaresi Kanunu ile kendisine yüklenen siyasi yürütme sıfatı kavramı nedeniyle idarenin atamadaki takdir yetkisinin geniş yorumlanması gerektiğini, bu nedenle idari işlemin yetki ve şekil unsuru dışında idari yargı mercilerince incelenemeyeceği tezini ileri sürmektedir. Buna karşın aksi görüş valiliğin genel idare esaslarına uygun yürütülen bir kamu görevi olduğu, bu nedenle atama ve görevden almalarda kamu yararı ve kamu hizmetleri gereği dışında bir gerekçe ileri sürülemeyeceği, bu nedenle atama işleminin yargı makamlarınca sebep ve konu unsuru bakımından da incelenmesi gerektiğini belirtmektedir.
