Property purchase in sharia court records: Method and diction

Abstract
In this study, the way properties are transected and the method followed in Shari a Court Records are analyzed. The documents related to property selling used to be recorded in a certain way called sakk / sakk-ı shari a . All details related to such transections used to be written in Shari a Court Records using this method in a way that no disputes would occur in the future. Therefore, the location of the property, the situation of the two parties of the transaction, the borders of the property, the premises of the property, the worth of the property, the type of contract, whether the price was taken or not, the date of the sale, and finally the member of jury used to be recorded. As the issues related to property sale were written in Shari a Court Records with sakk method in a similar way, giving related examples from any court record will be sufficient. In this study, the examples were taken from court records of Amid, which was the central county of Diyarbakir State, and Mardin, which was another county at the time.
Özet
Bu çalışmada, şeriye sicillerinde mülk alışverişlerinin ne şekilde yer aldığı ve bu kayıtlarda takip edilen usul tedkîk edilmiştir. Mülk satışları ile ilgili belgeler, sakk/sakk-ı şeriadı verilen, belirli bir usul içerisinde kaydedilirdi. Bu usul ile şeriye sicillerine kaydedilen mülk satışları ile ilgili kayıtlara, sonraki dönemlerde herhangi bir anlaşmazlığa yer bırakmayacak şekilde, alışveriş muamelesi ile ilgili tüm ayrıntılar yazılıyordu. Bu amaçla bu belgelere; alışverişe konu olan mülkün bulunduğu yer, alışverişte bulunan tarafların durumu, satılan mülkün sınırları, müştemilatı, icâb, kabûl, mülkün değerinin ne olduğu, mülkün ne tür bir akitle satıldığı, ücretin alınıp alınmadığı, satışın gerçekleştiği tarih ve en sonda da mahkemede bu hadiseye şahit olan kişilerin kaydedildiği görülüyor. Mülk alışverişi ile ilgili meseleler, sakk usulü ile benzer biçimde Şeriye sicillerine yazılmaları sebebiyle bunlara dair örnekleri herhangi bir sicil kaydından vermek yeterli olacaktır. Bu araştırmada örnekler Osmanlı idari taksimatında Diyarbekir eyaletinin merkez kazası olan Amid (bu günkü adıyla Diyarbakır) ile diğer bir kazası olan Mardine ait sicillerden verilmiştir.
