The Problem of Disciplinary Punishment by Medical Chambers to Public Servant Doctors

Abstract

In recent years, the Council of State has changed its view that “Physicians working in the public sector cannot be disciplined by the Medical Chambers”, which has been consistently expressed for many years. The fact that physicians working in the public sector can be disciplined both by their own disciplinary superiors and by the Medical Chambers causes hesitations in terms of “duplicity”. This situation is a matter of discussion on the grounds that the principle of not being punished repeatedly “ne bis in idem” for the same act, which is a universal legal principle, is violated. While the “temporary dismissal from profession” sanction is stipulated as an independent disciplinary punishment in the 5th article of the Turkish Medical Association’s Disciplinary Regulation, the “temporary or permanent disqualification from the profession” sanction according to Article 23/6- e of the Decree No. 663 for physicians working in the public sector. It is not envisaged as a disciplinary penalty, but is regulated as a separate administrative sanction. In our study, references are made to court decisions on the subject. It has been discussed to what extent physicians working in the public sector can be punished by the Honour Board of the Turkish Medical Chambers and the Turkish Medical Association. It has been evaluated whether this issue violates the “ne bis in idem” principle and disciplinary penalties to be taken by physicians working in the public sector in case of violating acts arising from their “public duties”. Differences in the nature of the of the disciplinary punishments that can be given to them by the Medical Chambers and the Honour Board of the Turkish Medical Association due to the violation of the “professional ethical principles” by the public physicians, have been emphasized. The problems that have arisen in this regard and the solution suggestions are given.

Danıştay, uzun yıllardır istikrarlı bir biçimde dile getirdiği “Kamu kesiminde görev yapan hekimlere Tabip Odaları ve Türk Tabipleri Birliği Onur Kurulu tarafından disiplin cezası verilemeyeceği” şeklindeki görüşünü, son yıllarda değiştirmiştir. Kamuda çalışan hekimlere; hem kendi disiplin amirleri tarafından, hem de Tabip Odaları ve Türk Tabipleri Birliği Onur Kurulu tarafından disiplin cezası verilebilmesi “mükerrerlik açısından” tereddütlere yol açmaktadır. Evrensel bir hukuk ilkesi olan, aynı fiilden dolayı mükerrer cezalandırılmama “ne bis in idem” ilkesinin ihlal edildiği gerekçesiyle bu durum tartışma konusu olmaktadır. Türk Tabipleri Birliği Disiplin Yönetmeliği’nin 5. maddesinde “geçici olarak meslekten alıkoyma” yaptırımı, müstakil bir disiplin cezası olarak öngörülmüşken, kamuda çalışan hekimler için 663 sayılı KHK’nın 23/6-e maddesine göre “meslekten geçici veya sürekli men” yaptırımı bir disiplin cezası olarak öngörülmeyip, ayrı bir idari yaptırım olarak düzenlenmiştir. Çalışmamızda konuyla ilgili mahkeme kararlarına da atıfta bulunularak, Tabip Odaları ve Türk Tabipleri Birliği Onur Kurulu tarafından hangi kapsam da kamuda çalışan hekimlere disiplin cezası verilebileceği, bu hususun “ne bis in idem” ilkesini ihlal edip etmediği, kamuda çalışan hekimlerin “kamusal görevlerinden” kaynaklanan fiilleri ihlal etmeleri durumunda alacakları disiplin cezaları ile “mesleki etik ilkeleri” ihlal etmelerinden dolayı Tabip Odaları ve Türk Tabipleri Birliği Onur Kurulu tarafından kendilerine verilebilecek disiplin cezalarının nitelik farklılıkları ve bu konuda ortaya çıkan sıkıntılar ile çözüm önerilerine yer verilmiştir.
