Abstract

The first constitution of the Republic of Turkey was “Teşkilât-ı Esasiye Kanunu” (The Constitution of 1921) andit was adopted on 20.01.1921. Although a century has passed and three more constitutions were entered into forceafter the Constitution of 1921, the first constitution of Republic of Turkey remains its importance. In thisframework, “the spirit of the Constitution of 1921” is still one of the most controversial issues. The main motiveswhich create this specific spirit are the extraordinary period of time that the Constitution was prepared under andthe discussions between the members of the Parliament who came from different regions of country and haddifferent point of views, beliefs, and ideologies. Accordingly, the spirit of the Constitution of 1921 is based onnational will, pluralism, and deliberation. This spirit has also had a vital effect on the assembly government systemthat was provided by the Constitution. This system is based on the supremacy of the parliament. Even though thatsystem started to alter with the Constitution of 1924, the importance of the parliament has continued. However,after the constitutional amendment in 2017, because of the new presidential government system, the role and theposition of the Parliament have been criticised. In this context, this paper will examine the spirit of the Constitutionof 1921, which is started to discuss again because of “a new constitution” idea, and try to make a comparisonbetween the system of the government provided by the Constitution of 1921 and the presidential governmentsystem.

Türkiye Cumhuriyeti’nin ilk anayasası Teşkilat-ı Esasiye Kanunu (1921 Anayasası), 20.01.1921 tarihinde kabul edilmiştir. 1921 Anayasası’nın kabulünün üzerinden yüz sene geçmiş, bu Anayasa’dan sonra farklı dönemlerde üç anayasa daha hazırlanıp yürürlüğe girmiş olsa da 1921 Anayasası önemini halen korumaktadır. Bu çerçevede, günümüzde tartışılmaya devam eden hususların başında “1921 Anayasası’nın ruhu” kavramı gelmektedir. 1921 Anayasası’nın olağanüstü koşullar altında, ülkenin çeşitli kesimlerinden gelen çok farklı görüşlere sahip milletvekillerinin yoğun tartışmalarının ve müzakerelerinin sonucunda hazırlanması bu özellikli “ruh”un ortaya çıkışının esas sebepleridir. Bu doğrultuda da 1921 Anayasası’nın ruhunun millî irade temelli, çoğulcu ve müzakereci yapısı öne çıkmaktadır. Bu ruh, Anayasa’da öngörülen hükûmet sistemi (meclis hükûmeti sistemi) üzerinde de etkili olmuştur. Yasama organının üstünlüğüne dayanan ve dünyada benzerine sık rastlanmayan bu sistem, 1921 Anayasası’ndan sonraki anayasalarda da Meclis’in üstünlüğü ve önemi bağlamında etkisini göstermeye devam etmiştir. 2017 yılında yapılan Anayasa değişikliği sonrasında uygulanmaya başlayan cumhurbaşkanlığı hükûmet sistemi ile ise Türkiye Büyük Millet Meclisi’nin rolü ve konumu, çeşitli eleştirilere konu olmuştur. Bu bağlamda, bu makalede yeni anayasa tartışmaları çerçevesinde yeniden gündeme gelen 1921 Anayasası’nın ruhu ile bu ruhun etkisiyle tasarlanan meclis hükûmeti sisteminin mevcut hükûmet sistemi ile mukayesesi ve 1921 Anayasası’nın ruhu ile cumhurbaşkanlığı hükûmet sisteminin bağdaştırılmasının mümkün olup olmadığı incelenmeye çalışılacaktır.
