An Analysis of Public Policy: Temporary Village Guards in Turkey

Abstract

In Max Weber s oft-cited definition of the state as a human community that claimsthe monopoly of the legitimate use of physical force within a given territory , it is theadministrative personnel of mandatory political organisation intended by the humancommunity that has the right to use force and tries to establish authority in that giventerritory. They generally exist in the form of army and police based on geographicaldivision. However, the state can organise, under special circumstances, the monopolyof the use of force outside the structure of traditional apparatus of force. The systemof temporary village guards, based on Law No. 442 of 1924 on villages, was establishedin 1985 as a force distinct from other security forces (police, army, gendarme) in orderto maintain order in rural areas. Village guards were introduced in 1924 in order toprotect villagers against potential security threats because of the unavailability of statesecurity forces in every region. The system of temporary village guards is a measuredeveloped for the self-defence of people against a constant threat thus contradictswith the provisions of 1924 Law both legally and practically. Despite the fact that thesystem of temporary village guards relies on, in a sense, the past experience, the reasonthat leads its formation is closer to similar organisations in practice that exist in othercountries. This study aims at to analyse the policy of temporary village guards. Theanalysis is based on process modeling within the context of relatively new discipline ofpublic policy in Turkey. Process model allows the analysis of a particular public policyas separated into stages. There are different views held in the literature on the numberof stages to analyze a policy. In this study, the policy toward temporary village guardsis analysed in four different stages as the emergence of the problem that leads to thepolicy, finding a solution, the implementation of the policy and the evaluation of thepolicy. The policy of temporary village guards is adopted to close these curity gapby arming the local people where the usual security apparatus is inadequate. In the system of village guards that develops in accordance with the policy objectives andproviding villagers with various privileges at the beginning, disorganization started toemerge in parallel with the increasing activity of PKK during the 1990s. The policy, atits early implementation, relied on consent and its lead to discontent during the 1990s.During the 1990s, the practice of village guards became an indication of loyalty to thestate on the part of the state rather than self-defence. During the 2000s, the abolitionof the system of village guards was frequently on the agenda as a result of the easingof the conflict between the state and the PKK. In the same period, the recruitment ofnew village guards was halted for a considerable time and improvements were maderegarding the status of village guards. The policy of temporary village guards has failedbecause of the problems it created during its implementation, violation of human rightby village guards and the status of village guards lacking the minimum rights of a publicemployee despite the initial success of the policy. Apart from these, it is concludedthat it is an extraordinary policy since having a weak legal basis, creating mostly a defacto situation and being secretive. It also led consequences contrary to its originalpublic interest objective. Being frequently criticized because of its failure, the policy oftemporary village guards has been preserved on the grounds of security on the partof the state and employment on the part of village guards.

Max Weberin sıklıkla başvurulan belirli bir toprakta meşru fiziki güç kullanma tekelinielinde tutan insan topluluğu şeklindeki devlet tanımında verili bölgede meşru güçkullanma hakkına sahip, sürekli hâkimiyeti sağlamaya çalışan insan topluluğu ilekastedilen zorunlu politik örgütün idari personelidir. Bunlar genel olarak coğrafi birayırımla ordu ve polis şeklinde var olmaktadır. Ancak devlet belirli durumlarda güçtekelini geleneksel zor aygıtları dışındaki farklı bir yapıda örgütleyebilmektedir. Yasaldayanağını 1924 tarih ve 442 sayılı Köy Kanunundan alan geçici köy koruculuğu sistemide devletin düzeni korumak için kırsalda diğer aygıtlarından (polis, ordu, jandarma)farklı olarak örgütlediği bir zor aracı olarak 1985te oluşturulmuştur. Köy koruculuğu1924te devletin güvenlik aygıtlarının her bölgede bulunmaması nedeniyle olasıtehlikeye karşı köylüyü korumak için uygulanmıştır. Geçici köy koruculuğu sistemihukuken ve uygulama açısından köy koruculuğu uygulamasından farklı olarak sürekli birtehlike durumuna karşı yerel halkın kendilerini korumaları için geliştirilmiş bir önlemdir.Her ne kadar tarihsel bir deneyimden faydalanılsa da geçici köy koruculuğununoluşturulma nedeni benzeri yapıların bulunduğu diğer ülke pratiklerine daha yakındır.Bu çalışma geçici köy koruculuğu politikasını analiz etmeyi amaçlamaktadır. Yapılananalizde Türkiyede görece yeni gelişmekte olan kamu politikası disiplini bağlamındasüreç model esas alınmıştır. Süreç model belirli bir kamu politikasının aşamalarınaayırarak analiz edilmesine olanak vermektedir. Literatürde politikanın kaç aşamadainceleneceği ile ilgili farklı öngörüler bulunmaktadır. Çalışmada ele alınan politika için;geçici köy koruculuğu politikasını doğuran sorunun ortaya çıkışı, çözümün üretilmesi,politikanın uygulanması ve değerlendirilmesi aşamaları şeklinde dört aşamalı birçözümleme yapılmıştır. Geçici köy koruculuğu politikası olağan zor aygıtlarının etkiliolmadığı köylerde ortaya çıkan güvenlik açığının yerel halkı silahlandırarak kapatılmasıamacıyla oluşturulmuştur. İlk yıllarda amaca uygun bir şekilde ve köylülere çeşitliimtiyazlar sağlanarak büyüyen koruculuk sisteminde 1990lı yıllarda, PKKnın artanfaaliyetlerine paralel olarak çözülmeler başlamıştır. İlk uygulandığı dönemde rıza esaslıgelişen politika 1990lı yıllarda birçok olumsuzluğa neden olmuştur. Devlet açısındanbu dönemde geçici köy koruculuğu sistemi, köylünün korunmasından çok devletebağlılığın göstergesi olmuştur. 2000li yıllarda Devlet ve PKK arasındaki çatışmanınyumuşaması paralelinde koruculuk politikasının kaldırılması sıklıkla gündeme gelmiştir.Bu dönemde korucu alımı uzun süre kesintiye uğramış ve ağırlıklı olarak sistem içindekikorucuların haklarında iyileştirmelere gidilmiştir. Geçici köy koruculuğu politikası birtakım başarılar elde etmişse de politikanın uygulanma aşamasında ortaya çıkardığıolumsuzluklar, sistem içindeki korucuların neden olduğu hak ihlalleri ve kendilerininbir kamu görevlisinin sahip olduğu asgari haklardan yoksun olması nedenleriyledeğerlendirildiğinde başarısız bir politikadır. Bunun yanı sıra zayıf bir hukuki temeledayandığı, fiili uygulamaların ağır bastığı ve içerisinde gizlilikleri barındıran olağan dışıbir politika olduğu sonucuna varılmıştır. Oluşturulma amacı olan kamu yararını sağlamaişlevinin aksi sonuçlar ortaya çıkarmıştır. Yapılan değerlendirmelerde başarısızlığınedeniyle sıklıkla eleştirilen politika devlet ve korucular açısından ağırlıklı olarakgüvenlik ve istihdam temelinde savunularak sürdürülmektedir.
