Limit of certified public accountants' (CPA) legal responsibility in taxing procedures

Abstract

Taxation is the most important authority that the states have. It can be said that payment of taxes is the most important obligation of individuals and institutions which are part of the community. After the acceptance of new liberal views, public services provided by the states have been widened in the principle of social state; and with this expansion, the importance of the collection of tax revenues has been risen. There are many taxing phases from the birth of the taxes to the payment phase. Because of the time constraint and operational difficulties, impossibilities, it is impossible for the authoritized public institutions, to implement each taxational operation. So, part of the auditing which is the most important part of taxation process has to be accomplished by independent auditors. However, delegating of some authority may naturally lead to some responsibilities. Thus, the taxes which is imposed by belief of public interest, most are the important fiscal sources for securing the public services. Consequently, the independent auditors will be responsible for ny tax loss of the Treasury because of negligence in auditing activities. However, in order to prevent any dispute related with any tax loss resulting from the negligence and the deficiency in auditing activities among the tax collectors, the tax payers and the other authorized persons, the legal aspect of the responsibility should be discussed througly and carefully. In this article, Certified Public Accountants’ (CPA) responsibilities issued from the auditing activities within the area of taxation procedures and the limit of these responsibilities have been discussed and have been tried to be identified.

Özet

Devletlerin sahip oldugu en önemli yetki vergilendirmedir. Toplumu olusturan hakiki ve hükmi sahısların da Devlete karsı üzerlerine düsen en önemli ödevin vergi ödeme yükümlülügü oldugu söylenebilir. Sosyal devlet ilkesi ile birlikte yeni liberal anlayısın benimsenmesi sonrası Devletlerin sunmus oldugu kamu hizmetlerinin yelpazesi genislemis; bu genisleme ile birlikte vergi gelirlerinin tahsilatının da önemi artmıstır. Vergilerin dogumundan tahsil sürecine kadar yapılması gereken bir çok vergilendirme islemleri bulunmaktadır. Fiili imkânsızlıklar ve zaman sorunu nedeniyle her bir vergilendirme isleminin, Devletin vergilendirme yetkisine haiz kamu kurum ve kurulusları tarafından yerine getirilmesi imkân dahilinde degildir. Bu bakımdan, vergilendirme islemlerinin en önemli ayagını olusturan denetim sürecinin bir bölümünün bagımsız denetim elemanları tarafından yerine getirilmesi zorunlu bir hâl almıstır. Ancak, bu kısmi yetki devrinin bir takım sorumlulukları dogurması da tabiidir. Bu bakımdan kamu yararı üstün tutularak salınan vergilerin, kamu hizmetlerinin görülmesinde en önemli finans kaynagı oldugu düsünülür ise; bu denetim faaliyetlerinden dolayı mükellefin eksik vergi ödemesi durumunda, bagımsız denetim elemanlarının da Hazinenin kaybından sorumlu tutulması söz konusu olacaktır. Ancak, Devletin vergilendirme islemlerini yürüttügü kurumları ile eksik ya da yanlıs denetim faaliyetleri sonucunda dogabilecek vergi aslı, cezası ve faizinden sorumlu olan kisilerin uyusmazlık yasamaması bakımından, sorumluluk müessesinin hukuki boyutunun iyi irdelenmesi gerekmektedir. Bu çalısmada, Yeminli Malî Müsavir (YMM)’lerin vergilendirme islemleri kapsamında yapmıs oldukları denetim faaliyetlerinden dogan sorumlulukları ve bu sorumlulukların sınırı belirlenmeye çalısılmıstır.
