A NEW ARRANGEMENT IN THE CODE OF CIVIL PROCEDURE: COMPLETION OF THE JUDGMENT

Abstract

What is essential in a case is that all the allegations and defenses put forward are evaluated together, and the case ends with a decision on each of them. However, in the case, a judgment may not have been rendered for various reasons about the matters that were put forward or that should be automatically decided by the court. In such a situation, a decision can be made regarding the matters for which no judgment has been made, thanks to the establishment of the completion of the judgment. While this legal institution is an institution that applied for arbitral awards, it has now become an institution that can also be applied for court decisions. In this study, the “completion of the judgment” institution, which is a new regulation for court decisions, will be examined. In addition to the examination of this legal institution, the relationship between the completion of the judgment and the partial judgment and the problems it may cause in practice will be pointed out.

Bir davada asıl olan, ileri sürülen tüm iddiaların ve savunmaların birlikte değerlendirilerek, her biri hakkında bir karar içeren hükümle davanın son bulmasıdır. Ancak davada, ileri sürülen ya da mahkemece kendiliğinden hükme geçirilmesi gereken hususlar hakkında çeşitli nedenlerle bir karar verilmemiş olabilir. Böyle bir durumda hükmün tamamlanması müessesesi sayesinde, hakkında karar verilmeyen hususlarla ilgili olarak bir karar verilebilecektir. Bu müessese, hakem kararları için uygulanmakta iken artık, mahkeme kararları için de uygulanması mümkün olan bir müessese hâline gelmiştir. Bu çalışmamızda, mahkeme kararları için yeni bir düzenleme olan “hükmün tamamlanması” müessesesinin incelenmesinin yanı sıra, hükmün tamamlanmasının kısmî hükümle olan ilişkisine ve uygulamada yaratabileceği sorunlara da işaret edilecektir.
