THE ERZURUM CONGRESS IN TERMS OF COMMUNITY LAW

Abstract
Societies in the Ottoman Empire were organizations that emerged and developed in the nine-teenthcentury,whenchangeandtransfor-mation took place. The Second Constitutional period provided an extremely rich environment for societies. The first law on the establishment and activities of organizations came into force on 16 August 1909. Although the law did not re-quire prior permission to establish a commu-nity, it was essential to notify the highest local administrative authority. After the Armistice of Mondros, the countrywide resistance organiza-tions created in Anatolia for the liberation of the homeland and the independence of the nation also operated within the framework of this law. In this way, the National Struggle Movement was organized. An attempt was made to ensure the peace and security of the people by counter-ing the occupying forces. During the period of national struggle, the people of the Eastern Black Sea and Eastern Anatolia also resisted both separatist minorities and the occupation forces with the organizations they created in or-der to prevent efforts to establish a Greek and Armenian State in their regions. Erzurum Con-gress was held as a result of the efforts of Trab-zon Muhafaza-i Hukuk-ı Milliye Commitee and Erzurum Vilayât-ı Şarkiye Müdafaa-i Hukuk-ı Milliye Commitee and with the participation of the representatives of other eastern provinces. The determination of Delegates, the meeting of the Congress, the decisions taken and the sub-sequent practices were carried out in accord-ance with the applicable laws. In this study, the establishmentoftheTrabzonMuhafaza-i Hukuk-ı Milliye Commitee and Erzurum Vila-yât-ı Şarkiye Müdafaa-i Hukuk-ı Milliye Com-mitee, the conditions of the meeting of the Er-zurum Congress, the activities of the Congress and the studies carried out after it were dis-cussed in accordance with the Law of Associa-tions.
Özet
Osmanlı Devleti’nde cemiyetler değişim ve dönüşü-mün yaşandığı 19. yüzyılda ortaya çıkıp gelişen örgütlen-melerdir. II. Meşrutiyet Dönemi cemiyetler açısından son derece zengin bir ortam sağlamıştır. Cemiyetlerin kuruluş ve faaliyetleri ile ilgili kanun 16 Ağustos 1909 tarihinde yürürlüğe girmiştir. Kanuna göre cemiyet kurmak için ön-ceden izin almak gerekmemekle birlikte mahallin en bü-yük mülki amirine bildirimde bulunmak esastı. Mondros Mütarekesi’nin ardından vatanın kurtuluşu ve milletin is-tiklâli için Anadolu’da oluşturulan Müdafaa-i Hukuk Ce-miyetleri de bu kanun çerçevesinde faaliyet göstermiştir. Bu sayede Millî Mücadele hareketi teşkilatlı bir hale geti-rilmiştir. İşgalci güçlere karşı konularak halkın huzur ve güvenliği sağlanmaya çalışılmıştır. Millî Mücadele Dö-nemi’nde Doğu Karadeniz ve Doğu Anadolu ahalisi de böl-gelerinde Rum ve Ermeni Devleti kurulmasına yönelik ça-baları engellemek amacıyla oluşturdukları teşkilatlarla gerek ayrılıkçı azınlıklara gerekse işgal güçlerine karşı di-reniş göstermiştir. Erzurum Kongresi, Trabzon Muha-faza-i Hukuk-ı Milliye Cemiyeti ile Vilayât-ı Şarkiye Mü-dafaa-i Hukuk-ı Milliye Cemiyeti Erzurum Şubesinin ça-baları sonucunda ve diğer Doğu vilayetleri temsilcilerinin de katılımı ile toplanmıştır. Delegelerin belirlenmesi, kongrenin toplanması, alınan kararlar ve ardından ger-çekleşen uygulamalar yürürlükteki kanunlara riayet edi-lerek gerçekleştirilmiştir. Bu çalışmada Trabzon Muha-faza-i Hukuk-ı Milliye Cemiyeti ile Vilayât-ı Şarkiye Mü-dafaa-i Hukuk-ı Milliye Cemiyeti Erzurum Şubesinin ku-ruluşu, Erzurum Kongresi’nin toplanma tarzı, kongre fa-aliyetleri ve sonrasında yürütülen çalışmalar yürürlük-teki Cemiyetler Kanunu’na göre ele alınmıştır.
