ʿIlla (Cause) of Interest In Islamic Law

Abstract

By taking reference the words and the deeds of the prophet Muḥammad, the Islamic lawyers and the academicians tried to determine the circumstances under which interest occurs, in other words, they tried to define what is the ʿilla (cause) of interest. Moving from gold and silver mentioned in the ḥadīth, ʿilla of interest has the characteristics of “being weighed with a kind” according to the Ḥanafīs and Ḥanbalīs, “having the characteristics of money as the dominant element” according to the Shāfiʿīs and Mālikīs, and “being characterized as only money” according to some jurists. Moving from wheat, barley, palm and salt mentioned in the ḥadīth mentioned in the ḥadīth, ʿilla of interest has the characteristics of” “being weighed with a kind” according to the Ḥanafīs and Ḥanbalīs, “being food” according to the Shāfiʿīs and “being food that can be stocked” according to the Mālikīs. Along with those, ʿilla like “fold goods” and “gender and class unity” have been proposed at the present time.

Özet

İslâm Hukukçuları ilgili hadislerde ifade edilen altı maldan hareketle, faizin hangi şartlarda gerçekleştiğini yani faiz illetinin ne olması gerektiğini tesbit etmeye çalışmışlardır. Hadislerde zikredilen altın ve gümüşten hareketle faiz illeti; Hanefîler ve Hanbelîlere göre, “cinsle beraber tartılır olma”, Şâfiîler ve Mâlikilere göre, “para olma özelliğinin hakim unsur olması”, bazı fakihlere göre de, “tam para olma özelliği taşıması” dır. Hadislerde zikredilen buğday, arpa, hurma ve tuzdan hareketle ise faiz illeti; Hanefîler ve Hanbelîlere göre, “cinsle beraber ölçülür olma”, Şâfiîlere göre, “gıda olma”, Mâlikilere göre, “stoklanabilen gıda olma” özelliği taşımasıdır. Bununla birlikte günümüzde “misli mal olma” veya “cins ve sınıf birliği” şeklinde illetlerde ileri sürülmüştür.
