Abstract

It is possible to link to content in a website by linking from one website to another. In this way, various works and contents on internet can be offered to unlimited number of people. This is the nature of the internet environment. However, interfering with copyright works by establishing an internet link can cause violation of copyright rights. In the Svensson judgment and the BestWater judgment, the European Court of Justice ruled that website owners could direct internet users by linking to copyright works where it is freely available on the internet. In the study, the effects of the surface link, deep link, framing and embedded link in the copyright rights were examined

Özet

Bir web sitesinden bir başka web sitesine link kurmak suretiyle web sitesinde yer alan içeriklere bağlantı sağlanması mümkündür. Bu sayede internet ortamında çeşitli eserler ve içerikler sınırsız sayıda kişinin erişimine sunulabilmektedir. Bu durum internet ortamının doğası gereğidir. Bununla birlikte internet linki kurmak suretiyle fikri eserlere müdahale edilmesi fikri hakların ihlaline neden olabilmektedir. Avrupa Adalet Mahkemesi, Svensson ve BestWater davalarında web sitesi sahiplerinin, internette serbestçe ulaşmanın mümkün olduğu fikri eserlere link kurmak suretiyle internet kullanıcılarını yönlendirebileceği yönünde karar vermiştir. Çalışmada yüzeysel link, derin link, çerçeveleme ve gömülü link kurmanın fikri haklara etkisi incelenmiştir
