A Single Quadripartite Sunni Madhhab: The Theoretical and Institutional Crystallization of the Four Schools of Law

Dört Parçalı Tek Sünnî Mezhep “Dört Hak Mezheb”in Kuramsal ve Kurumsal Kristalleşmesi

Abstract

This study is intended to examine the scholarly and political dynamics of the institutionalization of the four schools of law (al-madhāhib al-arba’ah), a phenomenon had grown out of the jurisprudential experience cultivated in the major cities during the first three centuries of Islam. It argues that the four schools have come to operate as a one extended Sunnī madhhab after going through a crystallization and consolidation process. It tries also to answer the question why the other defunct schools failed to be one of these four schools. Besides the doctrinal arguments made by scholars, educational and jurisdictional policies adopted by Muslim states are among the issues included in this study due to their relation to the formation of the discourse of ‘the four madhhabs’.

Özet

Bu çalışma, dört mezhebin Müslümanların dağıldıkları şehirlerde oluşan ilk üç asrın fıkıh birikimi içerisinden gelerek kurumsallaşmasının ilmi ve siyasi dinamiklerine dair bir süreç analizidenemesidir. Çalışma, dört mezhebin önce kristalleşerek sonrada bütünleşerek tek ve büyük birSünnî fıkıh mezhebi oluşturduğu tezi üzerinden ilerlemektedir. Diğer fıkıh mezheplerinin aynıbaşarıyı gösterememesini de bu tez çerçevesinde değerlendirmektedir. Fakihler arasındaki doktrintartışmaları yanında Müslüman devletler tarafından uygulanan eğitim ve yargı politikaları da dörtmezhep söyleminin oluşumundaki etkileri nedeniyle çalışmada konu edinilmiştir
