Abstract

The issue of proof and evidence was improved in due time in Roman civil procedure, and had a basis of the contemporary civil procudure. In particular, with the Cognitio Extra Ordinem way of judging, in a similar way to the contemporary procedure, the cases started to be heard and determined at one session and before people who were public officers. In Cognitio Extra Ordinem, even though evidences were not classified categorically, conclusiveness force of every single evidence was determined. In this period, not only the approach of “attaining of fact” started to become the prevailing opinion but also the principle that a judge needed both to know the rules of law was adopted and to decide accordingly, the processes of judging gain an importance top of the parties. Within this scope, it had become the duty of the judge to make an overall investigation of the matter of concern for the attainment of evidence and to discover the facts

Özet

Roma Hukukunda özel hukuka ilişkin davalarda, delil ve ispatkonusu zaman içinde gelişme göstermiş ve günümüzde esas alınansistemin temelleri atılmıştır. Özellikle Sistem Dışı Yargılamausulünün uygulanmaya başlanması ile günümüz yargılamasınabenzer şekilde davalar tek bir aşamada ve devlet memurustatüsündeki kişiler önünde görülüp karara bağlanmıştır. SistemDışı Yargılama usulünde her ne kadar deliller kategorik olaraksınıflandırılmasa da her bir delilin ispat gücü belirlenmiştir. Budönemde hem “gerçeğe ulaşma” görüşü egemen olmayabaşladığından hem de hâkimin hukuk kuralını bilmesi ve bunauygun karar vermesi ilkesi benimsendiğinden yargılama faaliyetitaraflar üstü bir öneme sahip olmuştur. Bu çerçevede, delillerin eldeedilmesi hususunda tam bir soruşturma yapmak ve gerçeği tespitetmek hâkimin görevi haline gelmiştir.
