TRUST LIABILITY OF THE DECEASED PERSON

Abstract
While private autonomy defines the limit of the opponent’s trust protection in the law of obligations, whereas the inheritance law remains largely dominated by the will of the deceased Person. The deceased as lord of his property may arrange his financial circumstances, referring the mandatory parts to his relatives for the time after his death, on the basis of testamentary freedom. The will (testament) is a unilateral legal transaction and is not required to be received, and the testator may revoke this legal act at any time without having to provide reasons. It is accepted that heritage does not provide a secured legal position of eligibility; it just provides a possibility. But there are cases in which the deceased does not silently meet his inheritance regulation; he rather offers someone a certain testamentary disposition as certain. In such situations, the testamentary successors cannot demand a formative inheritance contract from the deceased because a special bond has been established and death is a taboo subject. The reason for the deceased’ request is that testamentary successors made many changes in life in the hope of getting inheritance, i.e. working free of charge for the deceased and changing the subject of study. In the end, it turns out that the deceased has changed his will and made nothing in favour of this person. Therefore, it is necessary to study in this paper whether culpa in testando can find a place for a trust liability in inheritance, which in addition to the interests of the deceased, is also in the interests of the testamentary successors in need of protection. It has to be clarified whether the responsibility of the deceased has been actually excluded if the deceased has taken influence in the interest of another during his lifetime by culpable conduct.

Borçlar hukukunda karşı tarafın güveni, irade serbestîsini sınırlarken; miras hukukunda miras bırakanın iradesinin hâkim olduğu görülmektedir. Miras bırakan yasal mirasçılarının saklı payları dışındaki kısım üzerinde serbestçe tasarruf edebilmektedir. Miras hukukunda en çok karşılaşılan hukuki işlem olan vasiyetname tek taraflı olup, varması gerekli olmayan bir irade beyanıdır; ayrıca miras bırakan (vasiyet eden) herhangi bir sebep göstermeksizin dilediği zaman vasiyetnameden dönebilmektedir. Bu nedenle doktrinde mirasçılığın beklenen bir hak olmadığı, sadece bir beklenti olduğu ileri sürülmüştür. Kanuni mirasçılık dışında ancak ölüm anında geçerli bir ölüme bağlı tasarruf varsa kişi, mirasçı olarak hak sahibi olmaktadır. Ancak bazı olaylarda miras bırakan, biri lehine ölüme bağlı tasarrufta bulunacağını bu kişiye bildirmekte ve kişide bu hususta büyük bir güven uyandırmaktadır. Miras bırakanın bu iradesine güvenen ve tabu olan ölüm konusu nedeniyle şekil şartına bağlı olan bir miras sözleşmesi yapılmasını istemeyen kişi ise bu vaade dayanarak hayatında büyük değişiklikler yapabilmektedir. (Örneğin miras bırakan için ücretiz çalışma, öğrenim yaptığı alanı değiştirme gibi) Bu kişiler, miras bırakanın ölümüyle aslında kendileri lehine ölüme bağlı tasarruf yapılmadığını veya yapılan ölüme bağlı tasarrufların geri alındığını öğrenmektedirler. Bu nedenle bu çalışmada miras hukukunda miras bırakanın menfaati (tasarruf serbestîsi) dışında, atanmış mirasçı olacağına güven duyan kişilerin menfaatlerini koruyacak culpa in testando sorumluluğuna ihtiyaç duyulup duyulmadığı incelenecektir. Bilerek ve isteyerek sağlığında bir kişinin hayatını etkileyen miras bırakanın, doğan zararlardan sorumlu olup olmayacağı cevaplandırılması önemli bir konudur.
