Analysis and Classification of Rights in theField of Amnesty Authorization: The People Who were Ordered to Die of Prophet Muhammad in the Conquest of Mecca

Abstract
In the Siyar resources, it is reported that the Hz. Prophet has made a decision about the death of some people during the conquest of Mecca. There is noalliance on thesource of who these people are. The number of names on the list varies by one, six, eight, nine and twelve. There are two types of crimes committed for those people. The first one, the guilty is the guilt of insultandenmity to Hz. Prophet, and these cond is the guilt of apostasy (change of religion). It is argued that people who have been named in the accounts are taken to the death list due to the set woaccusations. The preliminaryaim of legal analysis and religious evaluations is humanity and Islam in which way it reflects the truth in context provisions of the narrations. In the study, the narrations have been classified according to sources, and then then arrations about the subjects have been analyzed from the legal point of view.
Özet
Siyer kaynaklarında Mekke’nin fethi sırasında Hz. Peygamber’in bazı kişiler hakkında ölüm kararı verdiği rivayet edilmektedir. Kaynaklarda bu kişilerin kimler olduğu konusunda ittifak yoktur. Listede ismi yer alanların sayısı bir, altı, sekiz, dokuz ve on iki şeklinde değişiklik göstermektedir. Söz konusu kişiler için iki tür suç isnadı vardır. Birincisi Hz. Peygambere hakaret ve düşmanlık suçu, ikincisi irtidat suçudur. Rivayetlerde ismi geçen kişilerin, bu iki suçlama sebebiyle ölüm listesine alındığı görüşü savunulmaktadır. Çalışmada rivayetler kaynaklarına göre tasnif edilmiş sonra da söz konusu kişiler hakkındaki rivayetler hukûkî açıdan tahlil edilmiştir. Yapılan hukûkî analiz ve dini değerlendirmelerin öncelikli amacı, rivayetlerde geçen hükümlerin insanî ve İslâmî açıdan hangi oranda doğruyu yansıttığıdır.
