THE RIGHT TO LIVE IN A HOUSE WORTHY OF HUMAN DIGNITY OF APARTMENT ATTENDANTS

Abstract

Right to housing is one of the fundamental social rights. International instruments guaranteeing the housing right as a part of the minimum standard of living. Today, the unplanned urbanization leads to violations of the right to housing. Economic, social and cultural changes in our country bring the new problems in urban areas. One of the problems of unplanned urbanization is that the house of apartment attendant is being under the minimum living conditions. We can claim that properties of apartment attendant houses are neglected and these are under the standards of human dignity. Apartment attendants which were forced to sit in damp and sunless together with their families were exposed to the negative effects of their houses on health and mental status every day. Therefore, the right to housing was one of the most important indicators of human life and the right to work of the apartment attendants. The government must determine the minimum standards with legal regulations and should control the required audit.

Konut hakkı en temel sosyal haklardan biridir. Uluslararası belgeler de asgari yaşam standardının bir parçası olarak konut hakkını güvence altına alırlar. Günümüzde, plansız kentleşme konut hakkı ihlallerinin doğmasına yol açmaktadır. Ülkemizde yaşanan ekonomik sosyal ve kültürel değişimler kentlerde yeni sorunları da beraberinde getirmektedir. Plansız kentleşme olgusunun meydana çıkardığı sorunlardan biri de apartman görevlisi konutlarının asgari yaşam koşullarının altında olmasıdır. Apartman görevlisi konutlarının niteliklerinin ihmal edildiği ve bunların insan onuruna yaraşır standartların altında olduğu iddia edilebilir. Rutubetli ve güneş görmeyen yerlerde aileleriyle birlikte oturmak zorunda kalan apartman görevlileri, ikamet ettikleri yerlerin fiziksel ve ruhsal sağlıklarına olan olumsuz etkilerini her gün yaşamaktadırlar. Dolayısıyla konut hakkı, apartman görevlileri için insanca yaşama ve çalışma hakkının en önemli göstergelerinden biridir. Devlet bu konuda yasal mevzuat vasıtasıyla asgari standartları belirlemeli ve gerekli denetim ödevini yerine getirmelidir.
