The Issue of Conversion of Children in the Ottoman State (1886-1914)

Abstract
In the Ottoman State, whose borders reached three continents and had different ethnic and religious elements, conversion to Islam was a very common situation. In order to complete the conversion to Islam, which is mentioned as “İhtida”, there are some conditions including being mentally healthy, being at a certain age range and not making this decision under pressure. In cases where these basic conditions are not met, legally it was not possible converting to Islam. In this study, we tried to show the situation of the children, who desire to convert to Islam, in the last period of the Ottoman Empire, based on the archive sources. In the introduction, we describe the conversion to Islam and the “apostasy”, and the situation of the people who does “İhtida” and “İrtidad”. In the continuation of the chapter, we discussed the reasons of the desire to convert to Islam. In the first part of the study, we determined the age of puberty in the Ottoman Empire and we examined the reasons of changing religion for those who did not reach the age of puberty and the problems experienced by them. In the second part of the study, we described, in the case of only one of the parents of a non-Muslim couple converts to Islam and they divorce, who has the custody of the children and which religion they belong to, and the attitude of the state in this matter. In the final part of the study, we discussed the issue of the registration of children who switch to another non-Muslim sect after the conversion.
Özet
Sınırları üç kıtaya ulaşan ve bünyesinde farklı etnik ve dini unsuru barındıran OsmanlıDevleti’nde Müslüman olmayan bireylerin İslâm dinine geçişleri oldukça sık görülen birdurumdur. Kayıtlara ihtida olarak geçen İslâmiyet’e geçişin tamamlanabilmesi için ihtida etmekisteyen kişinin belirli bir yaş aralığında, ruhen sağlıklı olması ve baskı altında bu kararı almamışolması şartları aranmıştır. Bu temel şartları sağlayamayan kişilerin İslâmiyet’e geçişi kanunenmümkün olmamıştır. Bu çalışmada Osmanlı Devleti’nin son dönemlerinde ihtida arzusunda olançocukların durumu arşiv kaynaklarına dayanılarak gösterilmeye çalışılmıştır. Çalışmanın girişbölümünde İslâmiyet’e geçiş ve İslâmiyet’ten ayrılış ana hatlarıyla gösterilmiş olup ihtida veyairtidâd eden kişilerin durumu ele alınmıştır. Bölümün devamında ise kişilerin neden İslâm dininegeçme arzusunda oldukları tartışılmıştır. Çalışmanın ilk bölümünde Osmanlı Devleti’nde bulûğyaşının tespiti ve bulûğ yaşına ermeyenlerin din değiştirme nedenleri ve yaşanan sorunlarincelenmiştir. Çalışmanın ikinci bölümünde ise Gayrimüslim çiftlerden birinin ihtida etmesi veçiftlerin boşanması sonrası evlilikten dünyaya gelen çocukların velayetinin kimde kalacağı vehangi dine mensup olacakları meselesi ve devletin bu konudaki tutumu gösterilmiştir. Sonbölümde ise ihtida sonrası ve başka bir Gayrimüslim mezhebe geçen çocukların nüfusa kaydımeselesi ele alınmıştır.
